1312 AN ACT to amend Tennessee Code Annotated, Title 8,
1413 Chapter 24, relative to compensation of county
1514 officials.

1716 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1817 SECTION 1. Tennessee Code Annotated, Section 8-24-102(d), is amended by
1918 designating the existing language as subdivision (d)(1) and adding the following as a new
2019 subdivision (d)(2):

2221 (A) If the department of economic and community development
2322 determines that during the previous fiscal year a county experienced substantial
2423 characteristics of economic distress, then that county may, by resolution of the
2524 county legislative body, forgo the increase in compensation provided in
2625 subdivision (d)(1).
2726 (B) The minimum compensation for county officials in a county that
2827 chose not to increase the minimum compensation under subdivision (d)(2)(A) is
2928 increased to the level it would have been if not for the resolution when:
3029 (i) The department of economic and community development
3130 determines that the county is no longer experiencing substantial
3231 characteristics of economic distress; or
3332 (ii) County officials take office following the next county election
3433 after the resolution was adopted.
3534 (C) The department of economic and community development shall
3635 make the determination of each county's level of economic distress no later than

4140 July 1 of each year based upon unemployment, per capita income, and poverty
4241 levels of all Tennessee counties using statistical data prepared by any agency of
4342 the state or federal government.
4443 (D) As used in this subdivision (d)(2), "substantial characteristics of
4544 economic distress" includes, but is not limited to, major loss of employment,
4645 recent high unemployment rates, traditionally low levels of family incomes, high
4746 levels of poverty, and high concentrations of employment in declining industries.
4847 SECTION 2. For purposes of determining which counties are experiencing economic
4948 distress, this act takes effect upon becoming a law, the public welfare requiring it. For all other
5049 purposes, this act takes effect July 1, 2025, the public welfare requiring it.
