16 | 16 | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: | |
17 | 17 | SECTION 1. Tennessee Code Annotated, Section 29-34-213, is amended by adding | |
18 | 18 | the following as a new subsection: | |
19 | 19 | (c) Notwithstanding subsection (b), a charitable organization that provides | |
20 | 20 | housing to a person who the charitable organization knows is unlawfully present in the | |
21 | 21 | United States may be held liable for a loss, damages, injury, or death resulting from a | |
22 | 22 | criminal offense committed by the person who is unlawfully present in the United States | |
23 | 23 | while the person is receiving housing services from the charitable organization if the | |
24 | 24 | charitable organization's conduct in providing housing constitutes negligence, gross | |
25 | 25 | negligence, or willful and wanton misconduct. | |
26 | 26 | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
