| 17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 17 | | SECTION 1. Chapter 985 of the Public Acts of 2024, is amended by deleting SECTION |

| 19 | 18 | | 22 and substituting: |

| 20 | 19 | | SECTION 22. Tennessee Code Annotated, Section 68-11-1602(10)(B), is |
|---|
| 21 | 20 | | amended by adding the following as a new subdivision: |

| 22 | 21 | | ( ) An acute care hospital; |
|---|
| 23 | 22 | | SECTION 23. Tennessee Code Annotated, Section 68-11-1602, is amended by |

| 24 | 23 | | adding the following as a new subdivision: |
|---|
| 25 | 24 | | ( ) "Acute care hospital" means a hospital with a primary focus on |
|---|
| 26 | 25 | | patients with an average length of stay of twenty-five (25) days or less; |

| 27 | 26 | | SECTION 24. Tennessee Code Annotated, Section 68-11-1607, is amended by |
|---|
| 28 | 27 | | adding the following as a new subsection: |
|---|
| 29 | 28 | | ( ) This part does not require a certificate of need to establish or operate |
|---|
| 30 | 29 | | an acute care hospital. |
|---|
| 31 | 30 | | SECTION 25. For the purpose of promulgating rules, this act takes effect upon |
|---|
| 32 | 31 | | becoming a law, the public welfare requiring it. For all other purposes: |
|---|
| 33 | 32 | | (1) Sections 11 and 18-21 take effect July 1, 2024, the public welfare |
|---|
| 34 | 33 | | requiring it; |
|---|
| 35 | 34 | | (2) Sections 1 and 2 take effect July 1, 2025, the public welfare requiring |
|---|
