13+AN ACT to amend Tennessee Code Annotated, Title 49,
14+Chapter 10 and Title 49, Chapter 6, relative to
15+special education.

1217 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
13-SECTION 1. Tennessee Code Annotated, Section 49-10-103, is amended by adding the
14-following as a new subsection:

1621 (1) An LEA shall notify a parent or guardian of a student at least ten (10)
17-calendar days before the student's I EP team meeting to ensure that the parent or
18-guardian has an opportunity to attend, unless the parent or guardian and the LEA
22+calendar days before the student's IEP meeting to ensure that the parent or
23+guardian has an opportunity to attend, unless the parent or guardian and LEA
1924 mutually agree to meet prior to ten (10) calendar days in accordance with rules
2025 promulgated by the state board of education.
2126 (2) An LEA shall provide the following to the parent or guardian of the
22-student who is the subject of the IEP team meeting at least forty-eight (48) hours
23-prior to the scheduled IEP team meeting:
24-(A) A copy of the student's evaluation report that is to be used in
25-the determination of the student's eligibility for special education or in the
26-development of the draft IEP; and
27+student who is the subject of the IEP meeting at least forty-eight (48) hours prior
28+to the IEP scheduled meeting:
29+ (A) A copy of all evaluations and assessments of the student
30+conducted for purposes of the student's IEP; and
2731 (B) If the LEA creates a draft IEP for the student prior to the IEP
28-team meeting, then a copy of the student's draft IEP, unless the student's
29-parent or guardian provides written notice to the LEA more than forty­
30-eight (48) hours prior to the scheduled IEP team meeting declining the
31-parent's or guardian's right to receive a copy of the draft I EP.
32-SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. HOUSE BILL NO. 861
