17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 17 | | SECTION 1. Tennessee Code Annotated, Section 68-221-709, is amended by deleting |
---|
19 | 18 | | the section and substituting: |
---|
20 | 19 | | (a) If the quarterly analysis of a water sample from a public water system by a |
---|
21 | 20 | | certified laboratory confirms that the level of fluoride in the sample exceeds four-tenths |
---|
22 | 21 | | milligrams per liter (0.4 mg/L), the public water system from which the sample was taken |
---|
23 | 22 | | must: |
---|
24 | 23 | | (1) Obtain laboratory analysis of water samples monthly for fluoride |
---|
25 | 24 | | levels; and |
---|
26 | 25 | | (2) Notify all of its customers that a water sample tested exceeded four- |
---|
27 | 26 | | tenths milligrams per liter (0.4 mg/L) of fluoride in a manner established by the |
---|
28 | 27 | | department. |
---|
29 | 28 | | (b) Once the monthly analysis of water samples for fluoride conducted pursuant |
---|
30 | 29 | | to subdivision (a)(1) confirms that the fluoride level in samples is less than four-tenths |
---|
31 | 30 | | milligrams per liter (0.4 mg/L) for three (3) consecutive months, the public water system |
---|
32 | 31 | | may resume quarterly laboratory analysis for fluoride. |
---|
33 | 32 | | (c) This part does not prohibit naturally occurring fluoride in the water supply; |
---|
34 | 33 | | provided, that fluoride levels do not exceed the maximum levels permitted by federal law |
---|
35 | 34 | | or federal regulations. |

40 | 39 | | SECTION 2. Tennessee Code Annotated, Section 68-221-708(c), is amended by |
---|
41 | 40 | | deleting the subsection and substituting: |
---|
42 | 41 | | (c) A public water system fluoridating its water supply on May 1, 2025, shall: |
---|
43 | 42 | | (1) Cease the addition of fluoride or fluoride compounds to the water |
---|
44 | 43 | | supply no later than July 31, 2025; and |
---|
45 | 44 | | (2) Provide written notice to their customers informing them of the |
---|
46 | 45 | | discontinuation of fluoridation and specify the date on which fluoridation will |
---|
47 | 46 | | cease. The notice must be issued thirty (30) days prior to the cessation of |
---|
48 | 47 | | fluoridation. |
---|
49 | 48 | | SECTION 3. Tennessee Code Annotated, Section 68-221-711, is amended by adding |
---|
50 | 49 | | the following new subdivision: |
---|
51 | 50 | | ( ) The addition of fluoride, or a fluoride compound, to the public drinking water |
---|
52 | 51 | | supply by the operator of a water supply system in the state. |
---|
53 | 52 | | SECTION 4. This act takes effect May 1, 2025, the public welfare requiring it. |
