13	13	AN ACT to amend Tennessee Code Annotated, Title 2,
14	14	relative to voting.

16	16	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
17	17	SECTION 1. Tennessee Code Annotated, Section 2-7-112(a)(1), is amended by
18	18	deleting the subdivision and substituting instead:
19	19	(A) A voter shall complete and sign an application for ballot, indicate the primary
20	20	in which the voter desires to vote, if any, and present it to a precinct registrar. The
21	21	application for ballot must include a space for the address of the voter's current
22	22	residence, and the voter shall write or print such address on the application when the
23	23	voter signs the application for ballot.
24	24	(B) At the time a voter presents an application for ballot, the voter shall present
25	25	to the precinct registrar one (1) form of identification for voter identification that bears the
26	26	name and photograph and residential address of the voter. The requirement to present
27	27	one (1) form of identification that bears the name and photograph and residential
28	28	address of the voter applies to persons voting pursuant to § 2-6-109; provided, however,
29	29	that a person voting in accordance with § 2-6-401(a) and (b) or § 2-6-601 is not required
30	30	to show an identification with a photograph and residential address of the voter.
31	31	(C) For purposes of verifying the person's identification on the application for
32	32	ballot, "form of identification for voter identification" must:
33	33	(i) Have been obtained with documented proof of citizenship of the
34	34	United States;

39	39	(ii) Include the voter's photograph, current residential address, and
40	40	expiration date of the identification;
41	41	(iii) Indicate that the individual meets eligibility requirements for voting,
42	42	including citizenship of the United States;
43	43	(iv) Accommodate for the permanently disabled and include a process for
44	44	permanent identification; and
45	45	(v) Not be an identification card issued to a student by an institution of
46	46	higher education.
47	47	(D) Using the computerized voter signature list or the electronic poll book, the
48	48	registrar shall make a determination whether the voter's address is different from the
49	49	address on the voter's permanent registration record or if the registration is in inactive
50	50	status. If the voter has changed residence, or the voter's registration is inactive, the
51	51	registrar shall follow the procedures for voting pursuant to §§ 2-7-140 and 2-7-141.
52	52	(E) If, upon verification of evidence of identification, it is found that the applicant
53	53	is entitled to vote, the registrar shall initial the application, note the date of the election,
54	54	the number on the voter's ballot application, and the primary or general election in which
55	55	the voter applies to vote.
56	56	(F) If the applicant's signature is illegible, the registrar shall print the name on the
57	57	application.
58	58	(G) The state coordinator of elections shall promulgate rules for training all
59	59	election commissioners, election employees, election officials, and poll workers for
60	60	procedures at the polls.
61	61	(H) The state coordinator of elections, in concurrence with the secretary of state,
62	62	shall provide public access to information regarding how to obtain and the proper use of
63	63	voter identification as required for the procedures to vote.

68	68	SECTION 2. Tennessee Code Annotated, Section 2-7-112(c), is amended by deleting
69	69	the subsection.
70	70	SECTION 3. Tennessee Code Annotated, Section 2-7-112(a)(3)(A)(vi), is amended by
71	71	deleting the language "punchcard or".
72	72	SECTION 4. Tennessee Code Annotated, Section 2-7-112(a)(3)(B)(i), is amended by
73	73	deleting the following language:
74	74	When provisional ballots have been cast utilizing punchcard or optiscan
75	75	technology, the counting of the provisional ballots shall be pursuant to rules
76	76	promulgated by the state coordinator of elections.
77	77	and substituting instead:
78	78	When provisional ballots have been cast utilizing a paper ballot, either marked by
79	79	hand or a ballot-marking device, and tabulated by optical scan technology, the
80	80	counting of the provisional ballots must be pursuant to rules promulgated by the
81	81	state coordinator of elections.
82	82	SECTION 5. Tennessee Code Annotated, Section 2-7-112(d), is amended by deleting
83	83	the subsection and substituting instead:
84	84	(d) For purposes of processing the voter's application to vote pursuant to
85	85	subdivision (a)(3), "verification of residential address" includes, but is not limited to, a
86	86	Tennessee driver license, a residential lease agreement, a utility bill, or other document
87	87	bearing the applicant's residential address. The "verification of residential address" must
88	88	not include a digital source or sources. Such verification may be on the same or
89	89	different identification from those listed in subsection (a).
90	90	SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
