1313 AN ACT to amend Tennessee Code Annotated, Title 2,
1414 relative to voting.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 2-7-112(a)(1), is amended by
1818 deleting the subdivision and substituting instead:
1919 (A) A voter shall complete and sign an application for ballot, indicate the primary
2020 in which the voter desires to vote, if any, and present it to a precinct registrar. The
2121 application for ballot must include a space for the address of the voter's current
2222 residence, and the voter shall write or print such address on the application when the
2323 voter signs the application for ballot.
2424 (B) At the time a voter presents an application for ballot, the voter shall present
2525 to the precinct registrar one (1) form of identification for voter identification that bears the
2626 name and photograph and residential address of the voter. The requirement to present
2727 one (1) form of identification that bears the name and photograph and residential
2828 address of the voter applies to persons voting pursuant to § 2-6-109; provided, however,
2929 that a person voting in accordance with § 2-6-401(a) and (b) or § 2-6-601 is not required
3030 to show an identification with a photograph and residential address of the voter.
3131 (C) For purposes of verifying the person's identification on the application for
3232 ballot, "form of identification for voter identification" must:
3333 (i) Have been obtained with documented proof of citizenship of the
3434 United States;

3939 (ii) Include the voter's photograph, current residential address, and
4040 expiration date of the identification;
4141 (iii) Indicate that the individual meets eligibility requirements for voting,
4242 including citizenship of the United States;
4343 (iv) Accommodate for the permanently disabled and include a process for
4444 permanent identification; and
4545 (v) Not be an identification card issued to a student by an institution of
4646 higher education.
4747 (D) Using the computerized voter signature list or the electronic poll book, the
4848 registrar shall make a determination whether the voter's address is different from the
4949 address on the voter's permanent registration record or if the registration is in inactive
5050 status. If the voter has changed residence, or the voter's registration is inactive, the
5151 registrar shall follow the procedures for voting pursuant to §§ 2-7-140 and 2-7-141.
5252 (E) If, upon verification of evidence of identification, it is found that the applicant
5353 is entitled to vote, the registrar shall initial the application, note the date of the election,
5454 the number on the voter's ballot application, and the primary or general election in which
5555 the voter applies to vote.
5656 (F) If the applicant's signature is illegible, the registrar shall print the name on the
5757 application.
5858 (G) The state coordinator of elections shall promulgate rules for training all
5959 election commissioners, election employees, election officials, and poll workers for
6060 procedures at the polls.
6161 (H) The state coordinator of elections, in concurrence with the secretary of state,
6262 shall provide public access to information regarding how to obtain and the proper use of
6363 voter identification as required for the procedures to vote.

6868 SECTION 2. Tennessee Code Annotated, Section 2-7-112(c), is amended by deleting
6969 the subsection.
7070 SECTION 3. Tennessee Code Annotated, Section 2-7-112(a)(3)(A)(vi), is amended by
7171 deleting the language "punchcard or".
7272 SECTION 4. Tennessee Code Annotated, Section 2-7-112(a)(3)(B)(i), is amended by
7373 deleting the following language:
7474 When provisional ballots have been cast utilizing punchcard or optiscan
7575 technology, the counting of the provisional ballots shall be pursuant to rules
7676 promulgated by the state coordinator of elections.
7777 and substituting instead:
7878 When provisional ballots have been cast utilizing a paper ballot, either marked by
7979 hand or a ballot-marking device, and tabulated by optical scan technology, the
8080 counting of the provisional ballots must be pursuant to rules promulgated by the
8181 state coordinator of elections.
8282 SECTION 5. Tennessee Code Annotated, Section 2-7-112(d), is amended by deleting
8383 the subsection and substituting instead:
8484 (d) For purposes of processing the voter's application to vote pursuant to
8585 subdivision (a)(3), "verification of residential address" includes, but is not limited to, a
8686 Tennessee driver license, a residential lease agreement, a utility bill, or other document
8787 bearing the applicant's residential address. The "verification of residential address" must
8888 not include a digital source or sources. Such verification may be on the same or
8989 different identification from those listed in subsection (a).
9090 SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
