| 17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 17 | | SECTION 1. This act is known and may be cited as "Akilah's Law." |
|---|
| 19 | 18 | | SECTION 2. Tennessee Code Annotated, Section 39-17-1316(q), is amended by |
|---|
| 20 | 19 | | adding the following as a new subdivision: |

| 21 | 20 | | (6) |
|---|
| 22 | 21 | | (A) It is an offense to sell, offer to sell, deliver, or transfer a firearm to a |
|---|
| 23 | 22 | | person knowing that the person has been a patient in a mental institution at any |
|---|
| 24 | 23 | | time within the previous five (5) years. |
|---|
| 25 | 24 | | (B) As used in this subdivision (q)(6): |
|---|
| 26 | 25 | | (i) "Mental institution" means any hospital, institution, clinic, |
|---|
| 27 | 26 | | evaluation facility, mental health center, or part thereof, that is used |
|---|
| 28 | 27 | | primarily for the care of persons with mental illness; and |
|---|
| 29 | 28 | | (ii) "Patient in a mental institution" means a person who was |
|---|
| 30 | 29 | | admitted, either voluntarily or involuntarily, to a mental institution unless |
|---|
| 31 | 30 | | the treatment was voluntary and solely for an alcohol abuse disorder and |
|---|
| 32 | 31 | | no other secondary substance abuse disorder or mental illness. |
|---|
| 33 | 32 | | SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it. |
