1312 AN ACT to amend Tennessee Code Annotated, Title 49,
1413 relative to education.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Title 49, Chapter 6, Part 10, is amended by
1817 adding the following as a new section:
1918 (a) An LEA or public charter school may create a physical education through
2019 community service program by partnering with a community organization to provide
2120 students in grades nine through twelve (9-12) with the opportunity to earn one-half (1/2)
2221 credit in physical education by completing yardwork projects for older persons and
2322 persons with disabilities within the community served by the LEA or public charter
2423 school. An LEA or public charter school may allow a student to participate in the
2524 program for no more than one (1) class period per school day.

2726 (1) In order to earn one-half (1/2) credit in physical education pursuant to
2827 subsection (a), the number of yardwork hours completed by the student, which
2928 must be overseen and documented by a community service partner, must be no
3029 less than the number of instructional hours required for a student to receive one-
3130 half (1/2) credit in a traditional physical education course, as determined by the
3231 state board of education.
3332 (2) One-half (1/2) credit in physical education earned by a student
3433 pursuant to this section may be counted toward the graduation requirements
3534 established by the state board pursuant to § 49-6-6001(a).

4039 (c) An LEA or public charter school that creates a physical education through
4140 community service program pursuant to this section shall:
4241 (1) Notify students in grades nine through twelve (9-12) of the opportunity
4342 to earn one-half (1/2) credit in physical education by completing yardwork
4443 projects for older persons and persons with disabilities within the community
4544 served by the LEA or public charter school;
4645 (2) Ensure that the parent or guardian of a student seeking to participate
4746 in the program has signed a written consent form authorizing their student to
4847 participate in the program before the student participates in any yardwork
4948 projects through, and for purposes of, the program;
5049 (3) Ensure that students are supervised at all times while providing
5150 yardwork services for older persons and persons with disabilities through the
5251 LEA's or public charter school's program;
5352 (4) Establish the parties responsible for transporting students to and from
5453 the location at which students are providing yardwork services and notify parents
5554 and guardians of the parties responsible for transporting their students; and
5655 (5) Ensure that all community service partners who will have contact with
5756 students or who will be working in close proximity to students through the
5857 program submit to, and complete, an investigation under § 49-5-413.
5958 (d) A community service organization that partners with an LEA or public charter
6059 school for purposes of a physical education through community service program shall
6160 maintain attendance records and records documenting the hours of yardwork services
6261 completed by each participating student and make the records available to the LEA or
6362 public charter school, as applicable.

6867 (e) A community service organization that partners with an LEA or public charter
6968 school for purposes of the LEA's or public charter school's physical education through
7069 community service program assumes all liability for a student while the student providing
7170 yardwork services in the community, but off the grounds of the student's school.
7271 (f) The time within which a student leaves school in order to provide yardwork
7372 services in the community for purposes of the program must align with the class
7473 schedule adopted by the LEA or public charter school for the school day.
7574 (g) A student who participates in the program must be credited with time spent in
7675 the program in the same manner as if the student were attending school, and the time
7776 spent in the program must be calculated as part of the school day.
7877 (h) Each LEA and public charter school that creates a physical education
7978 through community service program pursuant to this section shall annually:
8079 (1) Collect surveys from students who participated in the program,
8180 parents or guardians of students who participated in the program, community
8281 service partners participating in the program, and the older persons or persons
8382 with disabilities who received yardwork assistance through the program; and
8483 (2) Submit a report to the department of education on:
8584 (A) The number of students who participated in the program;
8685 (B) Satisfaction of the program's participants as determined by
8786 the surveys collected pursuant to subdivision (h)(1);
8887 (C) The type, length, and complexity of the yardwork or
8988 community service projects students completed through the program; and
9089 (D) The outcomes of the program.
9190 SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it.
