1212 AN ACT to amend Tennessee Code Annotated, Title 28
1313 and Title 40, Chapter 2, relative to commencement

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 40-2-101(q)(3)(B), is amended by
1818 deleting the subdivision and substituting:
1919 (B)
2020 (i) For offenses occurring on or after July 1, 2019, but before July 1,
2121 2025, in order to commence prosecution for an offense listed in subdivision (q)(1)
2222 under the circumstances described in subdivision (q)(3)(A), at a date that is more
2323 than twenty-five (25) years from the date the victim becomes eighteen (18) years
2424 of age, the prosecution is required to offer admissible and credible evidence
2525 corroborating the allegations or similar acts by the defendant.
2626 (ii) For offenses occurring on or after July 1, 2025, in order to commence
2727 prosecution for an offense listed in subdivision (q)(1) under the circumstances
2828 described in subdivision (q)(3)(A), at a date that is more than thirty (30) years
2929 from the date the victim becomes eighteen (18) years of age, the prosecution is
3030 required to offer admissible and credible evidence corroborating the allegations
3131 or similar acts by the defendant.
3232 SECTION 2. Tennessee Code Annotated, Section 40-2-101(q)(4), is amended by
3333 deleting the subdivision and substituting:
3434 (4) This subsection (q) applies to offenses:

3939 (A) Committed on or after July 1, 2019, except as provided in subdivision
4040 (q)(3)(B); or
4141 (B) Committed prior to July 1, 2019, unless prosecution for the offense is
4242 barred because the applicable time limitation set out in this section for
4343 prosecution of the offense expired prior to July 1, 2019.
4444 SECTION 3. Tennessee Code Annotated, Section 28-3-116(b)(2), is amended by
4545 deleting the language "on or after July 1, 2019" and substituting "on or after July 1, 2019, but
4646 before July 1, 2025".
4747 SECTION 4. Tennessee Code Annotated, Section 28-3-116(b), is amended by adding
4848 the following new subdivision:
4949 (3) For child sexual abuse that occurred on or after July 1, 2025, within the later
5050 of:
5151 (A) Thirty (30) years from the date the person becomes eighteen (18)
5252 years of age; or
5353 (B) If the injury or illness was not discovered at the time of the abuse,
5454 within three (3) years from the time of discovery of the abuse by the injured
5555 person.
5656 SECTION 5. This act takes effect July 1, 2025, the public welfare requiring it.
