| 17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 18 | | SECTION 1. Tennessee Code Annotated, Section 38-8-107, is amended by adding the |
|---|
| 19 | 19 | | following new subsection: |
|---|
| 20 | 20 | | (g) |
|---|
| 21 | 21 | | (1) The commission shall also issue a certificate of compliance to any |
|---|
| 22 | 22 | | person duly elected and sworn as a county constable; provided, that the person |
|---|
| 23 | 23 | | meets the qualifications for employment as a police officer and satisfactorily |
|---|
| 24 | 24 | | completes an approved recruit training program as required by this part. To |
|---|
| 25 | 25 | | retain such certification, the constable shall also successfully complete an annual |
|---|
| 26 | 26 | | in-service training session appropriate for the constable's responsibilities. |
|---|
| 27 | 27 | | (2) A constable is not required to be certified by the POST commission to |
|---|
| 28 | 28 | | perform the duties of a constable. |
|---|
| 29 | 29 | | (3) The POST commission shall not require a constable to work a certain |
|---|
| 30 | 30 | | number of hours in order to retain certification. |
|---|
| 31 | 31 | | SECTION 2. Tennessee Code Annotated, Section 8-10-104, is amended by deleting the |
|---|
| 32 | 32 | | section and substituting instead: |
|---|
| 33 | 33 | | (a) Each constable newly elected or appointed on or after July 1, 2025, must |
|---|
| 34 | 34 | | complete one hundred twenty-eight (128) hours of training in law enforcement duties. |
|---|
| 35 | 35 | | This training must be accomplished during the first year following election or |
|---|
| 36 | 36 | | appointment. |

| 41 | 41 | | (b) Prior to completing the required training, the constable must be paired with |
|---|
| 42 | 42 | | another constable who has completed all training requirements or a POST-certified law |
|---|
| 43 | 43 | | enforcement officer during the constable's official duties. This subsection (b) does not |
|---|
| 44 | 44 | | apply to a constable who is elected or appointed within five (5) years of having served as |
|---|
| 45 | 45 | | a full-time, POST-certified law enforcement officer. |
|---|
| 46 | 46 | | (c) The one hundred twenty-eight-hour training requirement may be waived if the |
|---|
| 47 | 47 | | officer successfully completes a comparable basic law enforcement course within one |
|---|
| 48 | 48 | | (1) year of the date of election or appointment. |
|---|
| 49 | 49 | | SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it. |
