1313 AN ACT to amend Tennessee Code Annotated, Title 49,
1414 relative to public charter schools.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 49-2-140, is amended by adding the
1818 following as a new subsection:
1919 (h) A public charter school, as defined in § 49-13-104, that is authorized by a
2020 county LEA may operate within the geographic boundaries of a municipal LEA pursuant
2121 to § 49-13-137. Subsections (c)-(g) do not apply to a public charter school that is
2222 authorized by a county LEA and that is operating within the geographic boundaries of a
2323 municipal LEA pursuant to § 49-13-137.
2424 SECTION 2. Tennessee Code Annotated, Section 49-13-105(a), is amended by
2525 deleting the third sentence of the subsection and substituting instead the following:
2626 Except as provided in § 49-13-137, a public charter school that is authorized by
2727 the commission must operate within the geographic boundaries of the local board
2828 of education that denied approval of the initial public charter school application.
2929 SECTION 3. Tennessee Code Annotated, Section 49-13-113(c), is amended by adding
3030 the language "pursuant to its charter agreement, but not pursuant to § 49-13-137," after the
3131 language "is located" wherever it appears in the subsection.
3232 SECTION 4. Tennessee Code Annotated, Section 49-13-113(b), is amended by
3333 deleting the subsection and substituting instead the following:

3939 (1) A public charter school authorized by the commission is open to
4040 students residing within the geographic boundaries of the LEA in which the public
4141 charter school is authorized to locate in its charter agreement.
4242 (2) A public charter school that operates, pursuant to § 49-13-137,
4343 outside the geographic boundaries of the LEA in which the public charter school
4444 is authorized to locate in its charter agreement is not open to students residing
4545 within the geographic boundaries of the LEA in which the public charter school is
4646 operating pursuant to § 49-13-137, unless the LEA in which the public charter
4747 school is authorized to locate in its charter agreement has a policy allowing out-
4848 of-district enrollment.
4949 SECTION 5. Tennessee Code Annotated, Section 49-13-113(d)(4)(E), is amended by
5050 deleting "of the LEA in which the public charter school is located" and substituting instead "of
5151 the LEA in which the public charter school is authorized to locate in its charter agreement".
5252 SECTION 6. Tennessee Code Annotated, Section 49-13-113(e), is amended by
5353 designating the existing language as subdivision (1) and adding the following as a new
5454 subdivision:
5555 (2) Subdivision (e)(1) does not allow a public charter school authorized by the
5656 ASD to enroll additional students residing within the geographic boundaries of an LEA in
5757 which the public charter school is operating pursuant to § 49-13-137.
5858 SECTION 7. Tennessee Code Annotated, Section 49-13-136(c), is amended by adding
5959 the following as a new subdivision:
6060 (7) An LEA in which one (1) or more public charter schools operate, but only
6161 pursuant to § 49-13-137, is not required to comply with the requirements of this
6262 subsection (c). This subsection (c) only applies to an LEA in which one (1) or more

6767 public charter schools operate pursuant to a charter agreement that authorizes the
6868 public charter school to locate within the geographic boundaries of that LEA.
6969 SECTION 8. Tennessee Code Annotated, Title 49, Chapter 13, is amended by adding
7070 the following as a new section:
7171 49-13-137. Limited operation outside the geographic boundaries of the LEA.
7272 A public charter school may operate outside the geographic boundaries of the
7373 LEA in which the public charter school is authorized to locate in its charter agreement, if:
7474 (1) The public charter school needs additional space, facilities, or
7575 buildings to serve the students of the public charter school; and
7676 (2) The public charter school enters into a written agreement for the
7777 lease of buildings or facilities, or portions thereof, that are located in the same
7878 county as the LEA in which the public charter school is authorized to locate in its
7979 charter agreement; provided, that the buildings or facilities, or portions thereof,
8080 leased by the public charter school are used for educational purposes.
8181 SECTION 9. The heading in this act is for reference purposes only and does not
8282 constitute a part of the law enacted by this act. However, the Tennessee Code Commission is
8383 requested to include the heading in any compilation or publication containing this act.
8484 SECTION 10. This act takes effect upon becoming a law, the public welfare requiring it,
8585 and applies to the 2025-2026 school year and each school year thereafter.
