1313 AN ACT to amend Tennessee Code Annotated, Title 12,
1414 Chapter 3, relative to public purchases.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 12-3-201(8)(B), is amended by
1818 deleting subdivision (8)(B) and substituting:

2020 (B) "Goods" also means all improvements to real property, including, but
2121 not limited to, buildings, structures, equipment, fixtures, and anything else
2222 permanently attached to real property, but does not include real property;
2323 SECTION 2. Tennessee Code Annotated, Section 12-3-1201(c), is amended by
2424 deleting the subsection and substituting:
2525 (c) To the extent permitted by federal law or regulations, local governments may
2626 make purchases of:
2727 (1) Goods, except motor vehicles other than those manufactured for a
2828 special purpose as defined in ยง 12-3-1208, or services included in federal
2929 general service administration contracts or other applicable federal open
3030 purchase contracts either directly or through the appropriate state agency;
3131 provided, that no purchase under this section shall be made at a price higher
3232 than that which is contained in the contract between the general services
3333 administration and the vendor affected; and
3434 (2) Goods and services directly, without bid or quotations, from vendors
3535 awarded general services administration (GSA) schedule contracts at prices

4040 equal to the vendor's current GSA schedule price. The terms and conditions
4141 agreeable to a local government may be used in lieu of the GSA terms and
4242 conditions in such purchases.
4343 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
