| 16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 12-3-201(8)(B), is amended by |
|---|
| 18 | 18 | | deleting subdivision (8)(B) and substituting: |

| 19 | 19 | | (8) |
|---|
| 20 | 20 | | (B) "Goods" also means all improvements to real property, including, but |
|---|
| 21 | 21 | | not limited to, buildings, structures, equipment, fixtures, and anything else |
|---|
| 22 | 22 | | permanently attached to real property, but does not include real property; |
|---|
| 23 | 23 | | SECTION 2. Tennessee Code Annotated, Section 12-3-1201(c), is amended by |
|---|
| 24 | 24 | | deleting the subsection and substituting: |
|---|
| 25 | 25 | | (c) To the extent permitted by federal law or regulations, local governments may |
|---|
| 26 | 26 | | make purchases of: |
|---|
| 27 | 27 | | (1) Goods, except motor vehicles other than those manufactured for a |
|---|
| 28 | 28 | | special purpose as defined in ยง 12-3-1208, or services included in federal |
|---|
| 29 | 29 | | general service administration contracts or other applicable federal open |
|---|
| 30 | 30 | | purchase contracts either directly or through the appropriate state agency; |
|---|
| 31 | 31 | | provided, that no purchase under this section shall be made at a price higher |
|---|
| 32 | 32 | | than that which is contained in the contract between the general services |
|---|
| 33 | 33 | | administration and the vendor affected; and |
|---|
| 34 | 34 | | (2) Goods and services directly, without bid or quotations, from vendors |
|---|
| 35 | 35 | | awarded general services administration (GSA) schedule contracts at prices |
|---|
| 36 | 36 | | |

| 40 | 40 | | equal to the vendor's current GSA schedule price. The terms and conditions |

| 41 | 41 | | agreeable to a local government may be used in lieu of the GSA terms and |

| 43 | 43 | | SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it. |
