16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-2-202, is amended by deleting |
---|
18 | 18 | | subsection (f) and substituting instead the following: |

20 | 20 | | (1) Notwithstanding ยง 49-2-201 or this section to the contrary, each board |
---|
21 | 21 | | of education for an LEA that operates at least one (1) high school shall select |
---|
22 | 22 | | one (1) junior or senior student to serve as a nonvoting student representative on |
---|
23 | 23 | | the board to serve as the voice of the student body. |
---|
24 | 24 | | (2) Nonvoting student representatives must be selected according to the |
---|
25 | 25 | | process established by the board pursuant to subdivision (f)(5) and must serve at |
---|
26 | 26 | | least one (1) one-year term on the board. Each one-year term coincides with the |
---|
27 | 27 | | school year for which the nonvoting student representative is selected. |

29 | 29 | | (A) Nonvoting student representatives must attend all board |
---|
30 | 30 | | meetings; provided, that the student representative shall not attend |
---|
31 | 31 | | confidential, nonpublic executive sessions of the board. |

32 | 32 | | (B) If a nonvoting student representative fails to attend more than |
---|
33 | 33 | | (2) board meetings during the student's term on the board, then the board |
---|
34 | 34 | | shall remove the student from the student's position on the board and |

41 | 41 | | (4) Each nonvoting student representative must: |
---|
42 | 42 | | (A) Be a junior or senior in a high school operated by the LEA; |
---|
43 | 43 | | (B) Serve at least one (1) one-year term on the board as a |
---|
44 | 44 | | nonvoting student representative, but may serve as a nonvoting student |
---|
45 | 45 | | representative for an additional one-year term if the student served as the |
---|
46 | 46 | | nonvoting student representative during the student's junior year. A |
---|
47 | 47 | | student is not eligible to serve as a nonvoting student representative on |
---|
48 | 48 | | the board if the student withdraws, transfers, or graduates from the high |
---|
49 | 49 | | school at which the student was enrolled at the time of selection; and |
---|
50 | 50 | | (C) Meet any additional requirements established by the board. |
---|
51 | 51 | | (5) Each board shall adopt a policy authorizing at least one (1) junior or |
---|
52 | 52 | | senior student who is enrolled at a high school operated by the respective LEA to |
---|
53 | 53 | | serve as a nonvoting student representative on the board in accordance with this |
---|
54 | 54 | | subsection (f). The board may establish additional eligibility requirements for |
---|
55 | 55 | | students who seek to serve on the board as a nonvoting student representative. |
---|
56 | 56 | | The policy must establish the process for selecting the nonvoting student |
---|
57 | 57 | | representative and must ensure students enrolled in one (1) high school |
---|
58 | 58 | | operated by the LEA have the same opportunity as students enrolled at another |
---|
59 | 59 | | high school operated by the LEA to serve as a nonvoting student representative. |
---|
60 | 60 | | (6) Students serve as nonvoting student members of a board without |
---|
61 | 61 | | compensation but may, at the discretion of the board, be reimbursed for |
---|
62 | 62 | | reasonable and necessary expenses incurred while engaged in board business. |

67 | 67 | | SECTION 2. For the purpose of developing and adopting the required policy, this act |
---|
68 | 68 | | takes effect upon becoming a law, the public welfare requiring it. For all other purposes, this act |
---|
69 | 69 | | takes effect July 1, 2025, the public welfare requiring it, and applies to the 2025-2026 school |
---|
70 | 70 | | year and each school year thereafter. |
