17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Title 63, Chapter 6, Part 2, is amended by |
---|
19 | 19 | | adding the following as a new section: |

20 | 20 | | (a) As used in this section: |
---|
21 | 21 | | (1) ''Immediate family'' means a physician's or podiatrist's spouse, parent, |
---|
22 | 22 | | child, sibling, or another individual in relation to whom a physician's or podiatrist's |
---|
23 | 23 | | personal or emotional involvement may render that physician or podiatrist unable |
---|
24 | 24 | | to exercise detached professional judgment in reaching diagnostic or therapeutic |
---|
25 | 25 | | decisions; |
---|
26 | 26 | | (2) ''Physician'' means a physician licensed under this chapter or chapter |
---|
27 | 27 | | 9 of this title; |
---|
28 | 28 | | (3) ''Podiatrist'' has the same meaning as defined in § 63-3-101; and |
---|
29 | 29 | | (4) ''Scheduled drug'' means a drug, substance, or immediate precursor |
---|
30 | 30 | | in Schedules I through V of the federal Controlled Substances Act (21 U.S.C. § |
---|
31 | 31 | | 812). |
---|
32 | 32 | | (b) A physician or podiatrist shall maintain records of all treatment provided |
---|
33 | 33 | | pursuant to this section. |
---|
34 | 34 | | (c) A physician or podiatrist shall not prescribe, dispense, or administer |
---|
35 | 35 | | medication for, or otherwise treat, the physician's or podiatrist's own self or immediate |
---|
36 | 36 | | family, except in minor, self-limited, short-term, or urgent, emergency situations. |

41 | 41 | | (d) Notwithstanding subsection (c) or (e), a physician or podiatrist shall not |
---|
42 | 42 | | prescribe, dispense, or administer a scheduled drug to the physician's or podiatrist's own |
---|
43 | 43 | | self or for immediate family. |
---|
44 | 44 | | (e) Notwithstanding subsection (c), a physician may prescribe, dispense, or |
---|
45 | 45 | | administer medication for, or otherwise treat, immediate family within the physician's |
---|
46 | 46 | | regular scope of practice if there is no other physician offering healthcare services at a |
---|
47 | 47 | | location within thirty (30) miles of the physician's primary practice site. |
---|
48 | 48 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
