1313 AN ACT to amend Tennessee Code Annotated, Title 49,
1414 relative to student assessments.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 49-10-1403, is amended by deleting
1818 subsection (e) and substituting:
1919 (e)
2020 (1) A parent of a participating student:
2121 (A) Shall ensure that the participating student is annually
2222 administered all Tennessee comprehensive assessment program (TCAP)
2323 tests, or successor tests authorized by the state board of education, that
2424 are administered to a public school student in the same grade or same
2525 course subject as the participating student;
2626 (B) In grade eleven (11) shall ensure that the student is
2727 administered the examination that is administered to public school
2828 students in grade (11) pursuant to § 49-6-6001(b)(1); and
2929 (C) In any of the grades kindergarten through three (K-3) shall
3030 ensure that the participating student is annually administered each of the
3131 three (3) Tennessee universal reading screeners, or universal reading
3232 screeners approved by the state board of education, as described in § 49-
3333 1-905(c) during each of the three (3) administration windows established
3434 by the department of education pursuant to § 49-1-905(c)(1).

3939 (2) A participating student's results on the tests administered pursuant to
4040 this subsection (e) must be reported to the parent of the student.
4141 (3) Students with disabilities who would have participated in the alternate
4242 assessments, as determined on the student's IEP, are exempt from the
4343 requirements in this subsection (e).
4444 SECTION 2. Tennessee Code Annotated, Section 49-6-2606(a)(1), is amended by
4545 deleting the subdivision and substituting:
4646 (1) As a condition of participating in the program:
4747 (A) Participating students must be annually administered the Tennessee
4848 comprehensive assessment program (TCAP) tests, or successor tests authorized
4949 by the state board of education, that are administered to a public school student
5050 in the same grade or same course subject as the participating student;
5151 (B) Participating students in grade eleven (11) must be administered the
5252 examination that is administered to public schools students in grade eleven (11)
5353 pursuant to § 49-6-6001(b)(1); and
5454 (C) Participating students in kindergarten through grade three (K-3) must
5555 annually be administered each of the three (3) Tennessee universal reading
5656 screeners, or universal reading screeners approved by the state board of
5757 education, as described in § 49-1-905(c) during each of the three (3)
5858 administration windows established by the department of education pursuant to §
5959 49-1-905(c)(1).
6060 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it.
