16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-10-1403, is amended by deleting |
---|
18 | 18 | | subsection (e) and substituting: |
---|
19 | 19 | | (e) |
---|
20 | 20 | | (1) A parent of a participating student: |
---|
21 | 21 | | (A) Shall ensure that the participating student is annually |
---|
22 | 22 | | administered all Tennessee comprehensive assessment program (TCAP) |
---|
23 | 23 | | tests, or successor tests authorized by the state board of education, that |
---|
24 | 24 | | are administered to a public school student in the same grade or same |
---|
25 | 25 | | course subject as the participating student; |
---|
26 | 26 | | (B) In grade eleven (11) shall ensure that the student is |
---|
27 | 27 | | administered the examination that is administered to public school |
---|
28 | 28 | | students in grade eleven (11) pursuant to § 49-6-6001(b)(1); and |
---|
29 | 29 | | (C) In any of the grades kindergarten through three (K-3) shall |
---|
30 | 30 | | ensure that the participating student is annually administered each of the |
---|
31 | 31 | | three (3) Tennessee universal reading screeners, or universal reading |
---|
32 | 32 | | screeners approved by the state board of education, as described in § 49- |
---|
33 | 33 | | 1-905(c), during each of the three (3) administration windows established |
---|
34 | 34 | | by the department of education pursuant to § 49-1-905(c)(1). |

39 | 39 | | (2) A participating student's results on the tests administered pursuant to |
---|
40 | 40 | | this subsection (e) must be reported to the parent of the student. |

41 | 41 | | (3) Students with disabilities who would have participated in the alternate |
---|
42 | 42 | | assessment, as determined on the student's IEP, are exempt from the |
---|
43 | 43 | | requirements in this subsection (e). |
---|
44 | 44 | | SECTION 2. Tennessee Code Annotated, Section 49-10-1404, is amended by adding |
---|
45 | 45 | | the following as new subsections: |
---|
46 | 46 | | (d) |
---|
47 | 47 | | (1) A participating school shall publish the school's lesson plans and |
---|
48 | 48 | | syllabus for each class offered by the school, a current list of materials in the |
---|
49 | 49 | | school's library collection, and the academic standards for each class offered by |
---|
50 | 50 | | the school on the school's website. |
---|
51 | 51 | | (2) As used in this subsection (d): |
---|
52 | 52 | | (A) "Library collection" means the materials made available to |
---|
53 | 53 | | students by the participating school, including materials made available to |
---|
54 | 54 | | students as part of a course curriculum; and |
---|
55 | 55 | | (B) "Materials" means books, periodicals, newspapers, |
---|
56 | 56 | | manuscripts, films, prints, documents, microfilm, discs, cassettes, |
---|
57 | 57 | | videotapes, video games, applications, and subscription content in any |
---|
58 | 58 | | form. |
---|
59 | 59 | | (e) A participating school shall ensure that all educators of the participating |
---|
60 | 60 | | school hold a valid license to teach in a public school that is issued by the state board of |
---|
61 | 61 | | education. |
---|
62 | 62 | | SECTION 3. Tennessee Code Annotated, Section 49-6-2607(e), is amended by adding |
---|
63 | 63 | | the following as new subdivisions: |

83 | 83 | | SECTION 4. Tennessee Code Annotated, Section 49-6-2606(a)(1), is amended by |

84 | 84 | | deleting the subdivision and substituting: |

85 | 85 | | (1) As a condition of participating in the program: |
---|
86 | 86 | | (A) Participating students must be annually administered the Tennessee |
---|
87 | 87 | | comprehensive assessment program (TCAP) tests, or successor tests authorized |
---|
88 | 88 | | by the state board of education, that are administered to a public school student |
---|
89 | 89 | | in the same grade or same course subject as the participating student; |
---|
