13	13	AN ACT to amend Tennessee Code Annotated, Section
14	14	53-8-103; Title 68, Chapter 110; Title 68, Chapter
15	15	111; Title 68, Chapter 14 and Title 68, Chapter 15,

18	18	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
19	19	SECTION 1. Tennessee Code Annotated, Section 53-8-103, is amended by deleting
20	20	subdivision (8) and substituting instead:
21	21	(8) "Food Code" means the 2009 Food Code as published by the United States
22	22	department of health and human services, public health service, food and drug
23	23	administration, or any subsequent Food Code, or portions thereof, published by the
24	24	United States department of health and human services, public health service, food and
25	25	drug administration, and adopted by rule by the commissioner;
26	26	SECTION 2. Tennessee Code Annotated, Section 68-14-303(4), is amended by
27	27	deleting the language "once per month" and substituting instead "every three (3) months".
28	28	SECTION 3. Tennessee Code Annotated, Section 68-14-503(4), is amended by
29	29	deleting the language "once every six (6) months," and substituting instead "once every year,".
30	30	SECTION 4. Tennessee Code Annotated, Section 68-14-703, is amended by deleting
31	31	subdivision (16) and by deleting subdivision (10) and substituting instead:
32	32	(10) "Food Code" means the 2009 Food Code as published by the United States
33	33	department of health and human services, public health service, food and drug
34	34	administration, or any subsequent Food Code, or portions thereof, published by the
35	35	United States department of health and human services, public health service, food and
36	36	drug administration, and adopted by rule by the commissioner;

41	41	SECTION 5. Tennessee Code Annotated, Section 68-14-713, is amended by deleting
42	42	the section and substituting instead:
43	43	(a) The commissioner of health shall set the permit fee by rule, promulgated in
44	44	accordance with the Uniform Administrative Procedures Act, compiled in title 4, chapter
45	45	5, for each of the following to operate:
46	46	(1) A food service establishment;
47	47	(2) An auxiliary food service operation;
48	48	(3) A temporary food service establishment;
49	49	(4) A child care center food service establishment;
50	50	(5) Congregate meal sites funded through the department of disability
51	51	and aging that are food service establishments;
52	52	(6) A school food service establishment; and
53	53	(7) A farmers market food unit.
54	54	(b) This section does not apply to family child care homes, as defined in § 71-3-
55	55	501.
56	56	(c) If the permit fee is delinquent for more than thirty (30) calendar days, a
57	57	penalty fee of one-half (1/2) the permit fee must be assessed, in addition to the permit
58	58	fee. If a check is returned for any reason, a penalty fee of one-half (1/2) the permit fee
59	59	must be assessed in addition to the permit fee. The permit fee, plus any penalty, must
60	60	be paid before the permit is issued.
61	61	(d) When an institution operates several group homes within close proximity to
62	62	each other, the permit fee must be assessed only against the institution and not against
63	63	each individual group home.
64	64	(e) This section does not apply to a blind vendor subject to title 71, chapter 4,
65	65	part 5.

70	70	SECTION 6. Tennessee Code Annotated, Title 68, Chapter 14, Part 7, is amended by
71	71	deleting Sections 68-14-723 – 68-14-726 in their entireties.
72	72	SECTION 7. Tennessee Code Annotated, Section 68-15-205, is amended by deleting
73	73	the first two sentences.
74	74	SECTION 8. Tennessee Code Annotated, Section 68-110-101(3), is amended by
75	75	inserting the following as new subdivisions:
76	76	( ) "Organized camp" does not include camps that are established for
77	77	and used exclusively for residential purposes other than camping, if:
78	78	(i) No permanent or semipermanent structures or buildings are
79	79	established or maintained on the property as living or sleeping quarters,
80	80	restrooms, or a cafeteria or kitchen, to provide an outdoor group living
81	81	experience for children or adults; and
82	82	(ii) Sites are rented for a week or longer;
83	83	( ) "Organized camp" does not include places established and used for a
84	84	short-term rental unit as defined in § 13-7-602(8);
85	85	SECTION 9. Tennessee Code Annotated, Section 68-110-106, is amended by deleting
86	86	the language "not less than ten dollars ($10.00) nor more than fifty dollars ($50.00)" and
87	87	substituting instead "not less than fifty dollars ($50.00) nor more than one hundred dollars
88	88	($100)".
89	89	SECTION 10. Tennessee Code Annotated, Title 68, Chapter 111, is amended by
90	90	deleting the chapter in its entirety.
91	91	SECTION 11. For the purpose of rulemaking, Section 5 of this act takes effect upon
92	92	becoming a law, the public welfare requiring it. For all other purposes, Section 5 of this act
93	93	takes effect January 1, 2026, the public welfare requiring it. For the purpose of rulemaking and

98	98	for all other purposes, all remaining sections of this act take effect upon becoming a law, the
99	99	public welfare requiring it.
