13	13	AN ACT to amend Tennessee Code Annotated, Title 38;
14	14	Title 53; Title 63 and Title 68, relative to
15	15	psychotropic drugs.

17	17	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
18	18	SECTION 1. Tennessee Code Annotated, Section 38-7-109, is amended by adding the
19	19	following as a new subsection:
20	20	(c)
21	21	(1)
22	22	(A) If a county medical examiner's office or regional forensic center is
23	23	conducting an autopsy on a decedent who is suspected to have committed a
24	24	mass shooting that resulted in the deaths of four (4) or more individuals, then the
25	25	county medical examiner or regional forensic center shall consult such
26	26	decedent's treating mental health professional or primary care physician, if
27	27	known and reasonably able to be identified through the decedent's next of kin, to
28	28	obtain information regarding the decedent's psychotropic drug use.
29	29	(B) The county medical examiner shall test the decedent for the
30	30	presence of any drugs, including psychotropic drugs.

32	32	(A) The county medical examiner's office or regional forensic center shall
33	33	disclose the drug use of the decedent to the University of Tennessee's health
34	34	science center and to the department of health.
35	35	(B) The county medical examiner's office or regional forensic center shall
36	36	not disclose any identifying information including the decedent's name or social

41	41	security number when disclosing the drug use of the decedent to the University
42	42	of Tennessee's health science center and to the department of health.
43	43	(3) The University of Tennessee's health science center shall study the drug
44	44	interactions between the psychotropic drugs and any other drugs that were present in
45	45	the decedent's system as provided by the county medical examiner as described in
46	46	subdivision (c)(2)(A).
47	47	(4) The University of Tennessee's health science center shall submit quarterly
48	48	reports of all data obtained pursuant to this section to the chair of the health and welfare
49	49	committee of the senate and the chair of the house of representatives committee having
50	50	jurisdiction over health-related matters.
51	51	(5) As used in this subsection (c), "psychotropic drug" means a medication
52	52	prescribed for the treatment of mental or behavioral health conditions or a drug
53	53	prescribed for any condition that exercises a direct effect upon the central nervous
54	54	system and that is capable of influencing and modifying mood, perceptions, and
55	55	behavior, including:
56	56	(A) Agents for control of mania and depression;
57	57	(B) Antidepressants;
58	58	(C) Antipsychotics;
59	59	(D) Anxiolytics;
60	60	(E) Hypnotics;
61	61	(F) Mood stabilizers;
62	62	(G) Hormonal medication with the primary goal of altering a person's
63	63	physical appearance and sexual characteristics existing at the person's birth;
64	64	(H) Psychomotor stimulants; and
65	65	(I) Stimulants.

70	70	(6) The county medical examiner, regional forensic center, department of health,
71	71	and the University of Tennessee's health science center must follow all relevant state
72	72	and federal privacy laws related to the implementation of this section.
73	73	SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
