17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Title 49, Chapter 6, Part 50, is amended by |
---|
19 | 19 | | adding the following as a new section: |
---|
20 | 20 | | (a) The department of health shall make available and require blood lead level |
---|
21 | 21 | | testing for all children prior to attendance at public schools that service any combination |
---|
22 | 22 | | of pre-kindergarten through grade twelve (pre-K-12) students. |
---|
23 | 23 | | (b) A child tested pursuant to this section who has elevated blood lead levels |
---|
24 | 24 | | must be immediately screened to determine if educational services pursuant to the |
---|
25 | 25 | | Individuals with Disabilities Education Act (20 U.S.C. ยง 1400 et seq.) may be required. |
---|
26 | 26 | | (c) A child tested pursuant to this section who has lead poisoning must receive |
---|
27 | 27 | | mandated wraparound services appropriate for lead poisoned children. |
---|
28 | 28 | | (d) This section does not apply to a child whose parent or guardian opts out of |
---|
29 | 29 | | such testing or referrals required by this section. |

30 | 30 | | SECTION 2. Tennessee Code Annotated, Title 37, Chapter 1, Part 1, is amended by |
---|
31 | 31 | | adding the following as a new section: |
---|
32 | 32 | | If a juvenile detention facility that receives federal funding is aware that a juvenile |
---|
33 | 33 | | in custody of such detention facility has elevated blood lead levels or lead poisoning, |
---|
34 | 34 | | then the detention facility shall, in collaboration with the department of health and local |
---|
35 | 35 | | education agencies, provide wraparound services appropriate for children with elevated |
---|
36 | 36 | | blood lead levels or lead poisoning for such juvenile. |

41 | 41 | | SECTION 3. Tennessee Code Annotated, Title 68, Chapter 1, Part 1, is amended by |

42 | 42 | | adding the following as a new section: |

43 | 43 | | The department shall make available and require blood lead level testing for a |
---|
44 | 44 | | pregnant woman who receives vouchers for the special supplemental food program for |
---|
45 | 45 | | women, infants, and children administered by the department. If a woman is tested |
---|
46 | 46 | | pursuant to this section and it is determined that she has elevated blood lead levels or |
---|
47 | 47 | | lead poisoning, then the department shall provide the woman specialized nutritional |
---|
48 | 48 | | services, education on how to mitigate lead in the body, and other mandated |
---|
49 | 49 | | wraparound services tailored for people with elevated blood lead levels or lead |
---|
50 | 50 | | poisoning. |
---|
51 | 51 | | SECTION 4. This act takes effect upon becoming a law, the public welfare requiring it. |
