1313 AN ACT to amend Tennessee Code Annotated, Title 37;
1414 Title 49; Title 63; Title 68 and Title 71, relative to
1515 blood lead level testing.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Title 49, Chapter 6, Part 50, is amended by
1919 adding the following as a new section:
2020 (a) The department of health shall make available and require blood lead level
2121 testing for all children prior to attendance at public schools that service any combination
2222 of pre-kindergarten through grade twelve (pre-K-12) students.
2323 (b) A child tested pursuant to this section who has elevated blood lead levels
2424 must be immediately screened to determine if educational services pursuant to the
2525 Individuals with Disabilities Education Act (20 U.S.C. ยง 1400 et seq.) may be required.
2626 (c) A child tested pursuant to this section who has lead poisoning must receive
2727 mandated wraparound services appropriate for lead poisoned children.
2828 (d) This section does not apply to a child whose parent or guardian opts out of
2929 such testing or referrals required by this section.
3030 SECTION 2. Tennessee Code Annotated, Title 37, Chapter 1, Part 1, is amended by
3131 adding the following as a new section:
3232 If a juvenile detention facility that receives federal funding is aware that a juvenile
3333 in custody of such detention facility has elevated blood lead levels or lead poisoning,
3434 then the detention facility shall, in collaboration with the department of health and local
3535 education agencies, provide wraparound services appropriate for children with elevated
3636 blood lead levels or lead poisoning for such juvenile.

4141 SECTION 3. Tennessee Code Annotated, Title 68, Chapter 1, Part 1, is amended by
4242 adding the following as a new section:
4343 The department shall make available and require blood lead level testing for a
4444 pregnant woman who receives vouchers for the special supplemental food program for
4545 women, infants, and children administered by the department. If a woman is tested
4646 pursuant to this section and it is determined that she has elevated blood lead levels or
4747 lead poisoning, then the department shall provide the woman specialized nutritional
4848 services, education on how to mitigate lead in the body, and other mandated
4949 wraparound services tailored for people with elevated blood lead levels or lead
5050 poisoning.
5151 SECTION 4. This act takes effect upon becoming a law, the public welfare requiring it.
