1313 AN ACT to amend Tennessee Code Annotated, Title 13,
1414 Chapter 21, relative to municipal rental property

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Title 13, Chapter 21, is amended by adding
1919 the following as a new part:
2020 13-21-401.
2121 As used in this part:
2222 (1) "Dwelling unit" means a building or structure or part thereof that is
2323 used for a home or residence by one (1) or more persons who maintain a
2424 household;
2525 (2) "Governing body" means the council, commission, or board, or other
2626 legislative body, charged with governing a municipality;
2727 (3) "Municipality" means any county, including any county having a
2828 metropolitan form of government, or incorporated city or town in this state; and
2929 (4) "Residential rental dwelling unit" means a dwelling unit that is leased
3030 or rented to one (1) or more tenants. However, a dwelling unit occupied in part
3131 by the dwelling unit owner is not a residential rental dwelling unit unless
3232 otherwise provided by the zoning ordinance of the municipality.

3434 (a) A municipality may create, implement, and enforce a rental property registry
3535 for all residential rental dwelling units within the municipality's jurisdiction.

4040 (b) A municipal registry of residential rental dwelling units must include, at a
4141 minimum, the following:
4242 (1) The physical address of each residential rental dwelling unit;
4343 (2) The name, mailing address, and contact information of the owner of
4444 the residential rental dwelling unit;
4545 (3) The name and contact information of the property management entity
4646 for the residential rental dwelling unit, if any;
4747 (4) The number of separate rental units at the residential rental dwelling
4848 unit; and
4949 (5) Verification that the residential rental dwelling unit complies with
5050 applicable building codes, zoning ordinances, and health and safety regulations.

5252 (a) Each owner of a residential rental dwelling unit located in a municipality that
5353 adopts a registry pursuant to § 13-21-402 shall register the residential rental dwelling
5454 unit with the municipality on an annual basis.
5555 (b) A municipality may charge a reasonable fee to cover administrative costs
5656 associated with maintaining the registry.
5757 (c) A failure by an owner to register a residential rental dwelling unit may result
5858 in civil penalties or other legal action, as established by the governing body of the
5959 municipality.
6060 (d) The following properties are exempt from registration under this section:
6161 (1) Owner-occupied residential rental dwelling units that rent fewer than
6262 two (2) units on the premises; and
6363 (2) Residential rental dwelling units owned by governmental or quasi-
6464 governmental entities.

7070 (a) A municipality that adopts a registry pursuant to § 13-21-402 shall integrate
7171 the registry into the municipality's code enforcement processes to assist in monitoring
7272 and enforcing compliance with health, safety, and housing standards.
7373 (b) A municipality may inspect a registered residential rental dwelling unit to
7474 ensure compliance, consistent with state and local laws.

7676 (a) Non-sensitive information that is contained in a registry established under
7777 this part is not confidential and may be made accessible to tenants and the public.
7878 (b) Proprietary or personal information contained in a registry established under
7979 this part is confidential and not open to inspection as a public record.

8181 This part does not preempt or override any existing state law or rule, but must be
8282 construed to supplement such laws and rules.

8484 A municipality that establishes a registry under this part shall submit an annual
8585 report to the department of economic and community development, in such manner as
8686 the department may require, that details the following:
8787 (1) The number of properties registered;
8888 (2) Code violations identified and resolved; and
8989 (3) The overall effectiveness of the registry in improving housing
9090 conditions.
9191 SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
