16 | 16 | | Chapter 3 of the Private Acts of 2019; and any other acts |

17 | 17 | | amendatory thereto, relative to the Town of Mason. |

19 | 19 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

20 | 20 | | SECTION 1. Chapter 120 of the Private Acts of 1915, as amended and rewritten by |
---|
21 | 21 | | Chapter 21 of the Private Acts of 2009, Chapter 44 of the Private Acts of 2018, Chapter 3 of the |
---|
22 | 22 | | Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting Sections |
---|
23 | 23 | | 12-14 and substituting instead: |

24 | 24 | | SECTION 12. |
---|
25 | 25 | | The board may appoint a Town Administrator who shall be under the control and |
---|
26 | 26 | | direction of the board. The Town Administrator shall report and be responsible to the |
---|
27 | 27 | | board. The board may, by ordinance, require the Town Administrator to perform any or |
---|
28 | 28 | | all the following duties: |
---|
29 | 29 | | (1) Administer the business of the Town; |
---|
30 | 30 | | (2) Make recommendations to the board for improving the quality and |
---|
31 | 31 | | quantity of public services to be rendered by the officers and employees to the |
---|
32 | 32 | | inhabitants of the Town; |
---|
33 | 33 | | (3) Keep the board fully advised as to the conditions and needs of the |
---|
34 | 34 | | Town; |
---|
35 | 35 | | (4) Report to the board the condition of all property, real and personal, |
---|
36 | 36 | | owned by the Town and recommend repairs or replacements as needed; |
---|
37 | 37 | | (5) Recommend to the board and suggest the priority of programs or |
---|
38 | 38 | | projects involving public works or public improvements that should be undertaken |
---|
39 | 39 | | by the Town; |

44 | 44 | | (6) Have general supervision of all the employees of the Town and see |
---|
45 | 45 | | that the ordinances and provisions of the charter are observed; |
---|
46 | 46 | | (7) Recommend specific personnel positions, as may be required for the |
---|
47 | 47 | | needs and operations of the Town, and propose personnel policies and |
---|
48 | 48 | | procedures for approval of the board; and |
---|
49 | 49 | | (8) Perform such other duties as may from time to time be designated or |
---|
50 | 50 | | required by the board. |
---|
51 | 51 | | The Town government shall be organized into such departments and offices as |
---|
52 | 52 | | shall be provided by ordinance. The Town Administrator may determine by executive |
---|
53 | 53 | | action the functions and duties of all departments and offices. The Town Administrator |
---|
54 | 54 | | may establish, abolish, merge, or consolidate offices, positions of employment, and |
---|
55 | 55 | | departments; may provide that the same person shall fill any number of offices and |
---|
56 | 56 | | positions of employment; and may transfer or change the functions and duties of offices, |
---|
57 | 57 | | positions of employment, and departments. The appointment and promotion of |
---|
58 | 58 | | employees of the Town of Mason shall be on the basis of merit, considering technical |
---|
59 | 59 | | knowledge required to perform satisfactorily the work, experience in the particular or |
---|
60 | 60 | | similar line of work, and administrative or supervisory qualifications. The Town |
---|
61 | 61 | | Administrator shall establish a system of personnel administration to provide for the |
---|
62 | 62 | | appointment of all employees of the Town of Mason. The Town Administrator, with |
---|
63 | 63 | | ratification of the majority of the Board, shall appoint the Town Attorney, department |
---|
64 | 64 | | heads, and such other positions as the Town Administrator shall deem necessary for the |
---|
65 | 65 | | proper and efficient administration of government for the Town of Mason. |
---|
66 | 66 | | SECTION 13. All contracts and bonds of the corporation shall be signed by the |
---|
67 | 67 | | Town Administrator and countersigned by the Recorder under the seal of the corporation |
---|
68 | 68 | | upon authority given by the Board at one of its meetings. All disbursements shall be |
---|
69 | 69 | | made by checks signed by the Town Recorder and by the Town Administrator. The |

74 | 74 | | Board may designate other officers to sign such checks in the absence or disability of |
---|
75 | 75 | | the Town Administrator or Town Recorder. |

76 | 76 | | SECTION 14. The Mayor, as a member of the board, may make motions and |
---|
77 | 77 | | shall have a vote on all matters coming before the board. |
---|
78 | 78 | | SECTION 2. Chapter 120 of the Private Acts of 1915, as amended and rewritten by |
---|
79 | 79 | | Chapter 21 of the Private Acts of 2009, Chapter 44 of the Private Acts of 2018, and any other |
---|
80 | 80 | | acts amendatory thereto, is amended by deleting the second paragraph of Section 19 and |
---|
81 | 81 | | substituting instead: |
---|
82 | 82 | | Ordinances shall be signed by the Mayor, although the Mayor's signature is not required |
---|
83 | 83 | | for the ordinance to take effect. Such ordinances shall be immediately taken charge of by the |
---|
84 | 84 | | Town Recorder, numbered, placed in an ordinance book, and there authenticated by the |
---|
85 | 85 | | signature of the Town Recorder and filed and preserved. |
---|
86 | 86 | | SECTION 3. This act shall have no effect unless it is approved by a two-thirds (2/3) vote |
---|
87 | 87 | | of the legislative body of the Town of Mason. Its approval or nonapproval shall be proclaimed |
---|
88 | 88 | | by the presiding officer of the legislative body and certified to the secretary of state. |
---|
89 | 89 | | SECTION 4. For the purpose of approving or rejecting the provisions of this act, it shall |
---|
90 | 90 | | be effective upon becoming a law, the public welfare requiring it. For all other purposes, it shall |
---|
91 | 91 | | become effective as provided in Section 3. |
