1312 AN ACT to amend Tennessee Code Annotated, Title 58,
1413 Chapter 8 and Title 67, Chapter 5, relative to
1514 emergency events.

1716 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1817 SECTION 1. Tennessee Code Annotated, Title 67, Chapter 5, Part 6, is amended by
1918 adding the following as a new section:
2019 (a) As used in this section:
2120 (1) "Property":
2221 (A) Means all real or personal property that is subject to taxation
2322 under this chapter; and
2423 (B) Does not include:
2524 (i) Intangible personal property, as defined in § 67-5-
2625 501(5); or
2726 (ii) Public utility property, as defined in § 67-5-501(9); and
2827 (2) "Qualified disaster" means any disaster certified by the federal
2928 emergency management agency (FEMA) occurring on or after September 26,
3029 2024, and before September 30, 2024.
3130 (b) In connection with a qualified disaster in order to promote the general
3231 welfare, subject to the requirements of this section and subject to an appropriation by the
3332 general assembly, the comptroller shall disburse payments directly to owners of
3433 property:
3534 (1) Whose property:

4039 (A) Was destroyed or damaged by a qualified disaster, as
4140 determined by the assessor of property by January 28, 2025; and
4241 (B) Is located in a county included in the FEMA declaration; and
4342 (2) Who owned the affected property at the time of the qualified disaster.
4443 (c) The payments disbursed pursuant to subsection (b) must be in an amount
4544 equal to the total amount of the tax levied on the property for tax year 2024 plus thirty
4645 percent (30%).
4746 (d) By June 30, 2025, owners of property who are eligible for payment under
4847 subsection (b) shall provide to the comptroller of the treasury all information and
4948 correctly completed documentation necessary for payment disbursement, as determined
5049 by the comptroller of the treasury. The comptroller shall determine the means by which
5150 owners of property must submit the necessary documentation and information. Failure
5251 to provide all necessary information and correctly completed documentation under this
5352 subsection (d) must result in forfeiture of eligibility for payment under this section.
5453 (e) This section applies regardless of whether the property was restored or
5554 replaced by December 31, 2024.
5655 (f) This section is deleted on December 31, 2025.
5756 SECTION 2. Tennessee Code Annotated, Section 58-8-106, is amended by deleting the
5857 section and substituting instead:
5958 Upon receiving a request for mutual aid in an occurrence or for assistance from a
6059 requesting party in a municipal, county, state, or federal state of emergency, a
6160 participating governmental entity may, subject to the approval of the chief executive
6261 officer of the governmental entity, send its personnel and equipment outside its
6362 boundaries and into any other jurisdiction necessary to respond to the request.
6463 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
