15 | 15 | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: | |
16 | 16 | SECTION 1. Tennessee Code Annotated, Section 39-17-309, is amended by deleting | |
17 | 17 | subsection (d) and substituting: | |

19 | 19 | (A) Except as provided in subdivision (d)(1)(B), a violation of subsection | |
20 | 20 | (b) is a Class D felony. | |
21 | 21 | (B) A violation of subsection (b) is a Class C felony if the victim of the | |
22 | 22 | offense was: | |
23 | 23 | (i) A minor under eighteen (18) years of age; or | |
24 | 24 | (ii) Selected by the defendant based on the victim's status as a | |
25 | 25 | minister, preacher, pastor, priest, rabbi, or other spiritual leader of a | |
26 | 26 | religious belief who has been ordained or otherwise designated in | |
27 | 27 | conformity with the customs of a church, temple, or other religious group | |
28 | 28 | or organization. | |
29 | 29 | (2) A violation of subsection (c) is a Class A misdemeanor. | |
30 | 30 | SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it. |
