1312 AN ACT to amend Tennessee Code Annotated, Title 47,
1413 relative to speculative tickets.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 47-50-119, is amended by deleting
1817 the section.
1918 SECTION 2. Tennessee Code Annotated, Section 47-50-121(a), is amended by adding
2019 the following as a new subdivision:
2120 ( ) "Speculative ticket":
2221 (A) Means a ticket that is not in the actual or constructive possession of a
2322 reseller at the time of sale, advertisement, or listing; and
2423 (B) Includes a ticket sold by a reseller that, at the time of resale, is not:
2524 (i) In the physical possession of the reseller;
2625 (ii) Owned by the reseller; or
2726 (iii) Under contract to be transferred to the reseller;
2827 SECTION 3. Tennessee Code Annotated, Section 47-50-121, is amended by adding
2928 the following as a new subsection:

3231 (A) A third-party ticket reseller shall not sell or offer to sell a
3332 speculative ticket.
3433 (B) A third-party ticket reseller that operates an internet website
3534 or other electronic service that provides a mechanism for two (2) or more

4039 parties to participate in a resale transaction shall not allow the sale or
4140 offering for sale of a speculative ticket.

4342 (A) The division of consumer affairs in the office of the attorney
4443 general and reporter shall enforce this subsection (e). The division shall
4544 establish a means by which a consumer may submit a complaint for a
4645 violation of this subsection.
4746 (B) If the division of consumer affairs finds that a third-party ticket
4847 reseller violated subdivision (e)(1)(A) or (e)(1)(B), then the division must
4948 assess a penalty of five thousand dollars ($5,000) per violation. Each
5049 instance of selling, offering for sale, or allowing the sale or offering for
5150 sale of a speculative ticket is a separate violation.
5251 (C) In addition to the remedy described in subdivision (e)(2)(B),
5352 an individual or entity that has reason to believe that a third-party ticket
5453 reseller violated subdivision (e)(1)(A) or (e)(1)(B) may bring a cause of
5554 action in a court of competent jurisdiction. If a court finds that the third-
5655 party ticket reseller violated subdivision (e)(1)(A) or (e)(1)(B), then the
5756 court must award the prevailing party actual damages, attorney fees, and
5857 reasonable court costs.
5958 SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it, and
6059 applies to conduct occurring on or after that date.
