16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-6-3050, is amended by deleting |
---|
18 | 18 | | subsection (b) and substituting instead the following: |
---|
19 | 19 | | (b) |
---|
20 | 20 | | (1) Except for home schools operated under subdivision (a)(2) or (a)(3), |
---|
21 | 21 | | a parent-teacher conducting a home school must provide: |
---|
22 | 22 | | (A) Notice to the local director of schools prior to each school |
---|
23 | 23 | | year of the parent-teacher's intent to conduct a home school and, for |
---|
24 | 24 | | purposes of reporting only, submit to the director of schools the names, |
---|
25 | 25 | | number, ages, and grade levels of the children to be home schooled; and |
---|
26 | 26 | | (B) A normed curriculum to the parent-teacher's home school |
---|
27 | 27 | | students that has been selected and approved by the parent-teacher. |
---|
28 | 28 | | (2) This state, an agency of this state, the local school district, or a local |
---|
29 | 29 | | government shall not require a parent-teacher of a home school student to: |
---|
30 | 30 | | (A) Administer any assessment, including, but not limited to, a |
---|
31 | 31 | | state-mandated standardized test or assessment such as a Tennessee |
---|
32 | 32 | | comprehensive assessment program test to their home school student; or |
---|
33 | 33 | | (B) Submit any information or documentation regarding the |
---|
34 | 34 | | education being provided by the parent-teacher their child at home, |
---|
35 | 35 | | including, but not limited to, the curricula, textbooks, and instructional |
---|

40 | 40 | | materials selected or being used by the parent-teacher. This subdivision |
---|
41 | 41 | | (b)(2)(B) does not prohibit this state or an agency of this state from |
---|
42 | 42 | | requesting or receiving the information or documentation necessary to |
---|
43 | 43 | | confirm that a parent-teacher is providing a normed curriculum to the |
---|
44 | 44 | | parent-teacher's child at home, as required in subdivision (b)(1)(B). |

---|
46 | 46 | | (A) This state, an agency of this state, the local school district, or |
---|
47 | 47 | | a local government shall not regulate, oversee, or otherwise impose any |
---|
48 | 48 | | requirements on a parent-teacher conducting a home school for the |
---|
49 | 49 | | parent-teacher's child or children, except as provided in this section. |
---|
50 | 50 | | (B) This subdivision (b)(3) does not prohibit this state or an |
---|
51 | 51 | | agency of this state from regulating, overseeing, or otherwise imposing |
---|
52 | 52 | | requirements on a parent-teacher or home school student if the parent- |
---|
53 | 53 | | teacher or home school student voluntarily elects to participate in a state |
---|
54 | 54 | | program that imposes certain requirements or standards on participants |
---|
55 | 55 | | that exceed those established in this section, or who has otherwise |
---|
56 | 56 | | applied for and received state funds for which this state or an agency of |
---|
57 | 57 | | this state has promulgated rules or established requirements or standards |
---|
58 | 58 | | for recipients that exceed those established in this section. |
---|
59 | 59 | | SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it. |
---|
