1313 AN ACT to amend Tennessee Code Annotated, Title 49,
1414 relative to home school.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 49-6-3050, is amended by deleting
1818 subsection (b) and substituting instead the following:
1919 (b)
2020 (1) Except for home schools operated under subdivision (a)(2) or (a)(3),
2121 a parent-teacher conducting a home school must provide:
2222 (A) Notice to the local director of schools prior to each school
2323 year of the parent-teacher's intent to conduct a home school and, for
2424 purposes of reporting only, submit to the director of schools the names,
2525 number, ages, and grade levels of the children to be home schooled; and
2626 (B) A normed curriculum to the parent-teacher's home school
2727 students that has been selected and approved by the parent-teacher.
2828 (2) This state, an agency of this state, the local school district, or a local
2929 government shall not require a parent-teacher of a home school student to:
3030 (A) Administer any assessment, including, but not limited to, a
3131 state-mandated standardized test or assessment such as a Tennessee
3232 comprehensive assessment program test to their home school student; or
3333 (B) Submit any information or documentation regarding the
3434 education being provided by the parent-teacher their child at home,
3535 including, but not limited to, the curricula, textbooks, and instructional

4040 materials selected or being used by the parent-teacher. This subdivision
4141 (b)(2)(B) does not prohibit this state or an agency of this state from
4242 requesting or receiving the information or documentation necessary to
4343 confirm that a parent-teacher is providing a normed curriculum to the
4444 parent-teacher's child at home, as required in subdivision (b)(1)(B).

4646 (A) This state, an agency of this state, the local school district, or
4747 a local government shall not regulate, oversee, or otherwise impose any
4848 requirements on a parent-teacher conducting a home school for the
4949 parent-teacher's child or children, except as provided in this section.
5050 (B) This subdivision (b)(3) does not prohibit this state or an
5151 agency of this state from regulating, overseeing, or otherwise imposing
5252 requirements on a parent-teacher or home school student if the parent-
5353 teacher or home school student voluntarily elects to participate in a state
5454 program that imposes certain requirements or standards on participants
5555 that exceed those established in this section, or who has otherwise
5656 applied for and received state funds for which this state or an agency of
5757 this state has promulgated rules or established requirements or standards
5858 for recipients that exceed those established in this section.
5959 SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
