16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 53-7-202, is amended by adding the |
---|
18 | 18 | | following new subdivision: |
---|
19 | 19 | | ( ) "Cell-cultured food product": |
---|
20 | 20 | | (A) Means a food product intended for use as human food that is |
---|
21 | 21 | | produced without slaughter by growing, in a controlled environment, cells |
---|
22 | 22 | | harvested from species amenable to the Federal Meat Inspection Act; the |
---|
23 | 23 | | Federal Poultry Products Inspection Act; or cells harvested from shellfish species |
---|
24 | 24 | | or big game, game birds, or fish, as those terms are defined in § 70-1-101; and |
---|
25 | 25 | | (B) Includes food or a food additive produced in the manner described in |
---|
26 | 26 | | subdivision ( )(A) and used as an ingredient or component in a food; |
---|
27 | 27 | | SECTION 2. Tennessee Code Annotated, Section 53-7-202, is amended by deleting |
---|
28 | 28 | | subdivision (15) and substituting: |
---|
29 | 29 | | (15) "Meat": |
---|
30 | 30 | | (A) Means the edible part of the muscle of cattle, deer, sheep, swine, or |
---|
31 | 31 | | goats that is skeletal or that is found in the tongue, in the diaphragm, in the heart, |
---|
32 | 32 | | or in the esophagus, with or without the accompanying and overlying fat, and the |
---|
33 | 33 | | portions of bone, skin, sinew, nerve, and blood vessels that normally accompany |
---|
34 | 34 | | the muscle tissue and that are not separated from it in the process of dressing; |
---|
35 | 35 | | and |
---|
36 | 36 | | |

43 | 43 | | SECTION 3. Tennessee Code Annotated, Section 53-7-202, is amended by deleting |

44 | 44 | | subdivision (21) and substituting: |

---|
46 | 46 | | (A) Means a live or slaughtered domesticated bird; and |
---|
47 | 47 | | (B) Does not include a cell-cultured food product; |
---|
48 | 48 | | SECTION 4. Tennessee Code Annotated, Title 49, Chapter 6, is amended by adding |
---|
49 | 49 | | the following as a new part: |

50 | 50 | | 49-6-4601. Part definition. |
---|
51 | 51 | | As used in this part, "cell-cultured food product": |
---|
52 | 52 | | (1) Means a food product intended for use as human food that is |
---|
53 | 53 | | produced without slaughter by growing, in a controlled environment, cells |
---|
54 | 54 | | harvested from species amenable to the Federal Meat Inspection Act (21 U.S.C. |
---|
55 | 55 | | § 601 et seq.); the Federal Poultry Products Inspection Act (21 U.S.C. § 451 et |
---|
56 | 56 | | seq.); or cells harvested from shellfish species or big game, game birds, or fish, |
---|
57 | 57 | | as those terms are defined in § 70-1-101; and |
---|
58 | 58 | | (2) Includes food or a food additive produced in the manner described in |
---|
59 | 59 | | subdivision (1) and used as an ingredient or component in a food. |

60 | 60 | | 49-6-4602. Prohibition on cell-cultured food products in school lunch programs. |

61 | 61 | | An LEA or public charter school shall not offer or distribute a cell-cultured food |
---|
62 | 62 | | product through the LEA's or public charter school's school nutrition program or another |
---|
63 | 63 | | source through which the LEA or public charter school provides food to students. |
---|

72 | 72 | | (1) May award compensatory damages, injunctive relief, or any other |
---|
73 | 73 | | appropriate relief to a prevailing party who establishes a violation of this part; and |
---|
74 | 74 | | (2) Shall award court costs, expenses, and reasonable attorney fees to a |
---|
75 | 75 | | prevailing party who establishes a violation of this part. |
---|
76 | 76 | | 49-6-4604. Repeal. |
---|
77 | 77 | | This part terminates on July 1, 2035. |

78 | 78 | | SECTION 5. Tennessee Code Annotated, Title 49, Chapter 1, Part 1, is amended by |

---|

88 | 88 | | (2) Includes food or a food additive produced in the manner described in |

89 | 89 | | subdivision (a)(1) and used as an ingredient or component in a food. |

90 | 90 | | (b) A public institution of higher education shall not offer or distribute a cell- |

91 | 91 | | cultured food product in the institution's food service center or another source through |
---|
92 | 92 | | which the institution provides food to students. |
