1212 AN ACT to amend Tennessee Code Annotated, Title 40;
1313 Title 44; Title 47; Title 49 and Title 53, relative to
1414 cell-cultured food products.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 53-7-202, is amended by adding the
1818 following new subdivision:
1919 ( ) "Cell-cultured food product":
2020 (A) Means a food product intended for use as human food that is
2121 produced without slaughter by growing, in a controlled environment, cells
2222 harvested from species amenable to the Federal Meat Inspection Act; the
2323 Federal Poultry Products Inspection Act; or cells harvested from shellfish species
2424 or big game, game birds, or fish, as those terms are defined in § 70-1-101; and
2525 (B) Includes food or a food additive produced in the manner described in
2626 subdivision ( )(A) and used as an ingredient or component in a food;
2727 SECTION 2. Tennessee Code Annotated, Section 53-7-202, is amended by deleting
2828 subdivision (15) and substituting:
2929 (15) "Meat":
3030 (A) Means the edible part of the muscle of cattle, deer, sheep, swine, or
3131 goats that is skeletal or that is found in the tongue, in the diaphragm, in the heart,
3232 or in the esophagus, with or without the accompanying and overlying fat, and the
3333 portions of bone, skin, sinew, nerve, and blood vessels that normally accompany
3434 the muscle tissue and that are not separated from it in the process of dressing;

4040 (B) Does not include:
4141 (i) The muscle found in the lips, snout, or ears; or
4242 (ii) A cell-cultured food product;
4343 SECTION 3. Tennessee Code Annotated, Section 53-7-202, is amended by deleting
4444 subdivision (21) and substituting:
4545 (21) "Poultry":
4646 (A) Means a live or slaughtered domesticated bird; and
4747 (B) Does not include a cell-cultured food product;
4848 SECTION 4. Tennessee Code Annotated, Title 49, Chapter 6, is amended by adding
4949 the following as a new part:
5050 49-6-4601. Part definition.
5151 As used in this part, "cell-cultured food product":
5252 (1) Means a food product intended for use as human food that is
5353 produced without slaughter by growing, in a controlled environment, cells
5454 harvested from species amenable to the Federal Meat Inspection Act (21 U.S.C.
5555 § 601 et seq.); the Federal Poultry Products Inspection Act (21 U.S.C. § 451 et
5656 seq.); or cells harvested from shellfish species or big game, game birds, or fish,
5757 as those terms are defined in § 70-1-101; and
5858 (2) Includes food or a food additive produced in the manner described in
5959 subdivision (1) and used as an ingredient or component in a food.
6060 49-6-4602. Prohibition on cell-cultured food products in school lunch programs.
6161 An LEA or public charter school shall not offer or distribute a cell-cultured food
6262 product through the LEA's or public charter school's school nutrition program or another
6363 source through which the LEA or public charter school provides food to students.

6969 A parent who is affected, or whose student is affected, by a violation of this part
7070 may bring a civil action against the LEA or public charter school in a court of competent
7171 jurisdiction. The court in such action:
7272 (1) May award compensatory damages, injunctive relief, or any other
7373 appropriate relief to a prevailing party who establishes a violation of this part; and
7474 (2) Shall award court costs, expenses, and reasonable attorney fees to a
7575 prevailing party who establishes a violation of this part.
7676 49-6-4604. Repeal.
7777 This part terminates on July 1, 2035.
7878 SECTION 5. Tennessee Code Annotated, Title 49, Chapter 1, Part 1, is amended by
7979 adding the following as a new section:
8080 49-7-190.
8181 (a) As used in this section, "cell-cultured food product":
8282 (1) Means a food product intended for use as human food that is
8383 produced without slaughter by growing, in a controlled environment, cells
8484 harvested from species amenable to the Federal Meat Inspection Act (21 U.S.C.
8585 § 601 et seq.); the Federal Poultry Products Inspection Act (21 U.S.C. § 451 et
8686 seq.); or cells harvested from shellfish species or big game, game birds, or fish,
8787 as those terms are defined in § 70-1-101; and
8888 (2) Includes food or a food additive produced in the manner described in
8989 subdivision (a)(1) and used as an ingredient or component in a food.
9090 (b) A public institution of higher education shall not offer or distribute a cell-
9191 cultured food product in the institution's food service center or another source through
9292 which the institution provides food to students.

9797 (c) A student who is affected by a violation of this section may bring a civil action
9898 against the public institution of higher education in a court of competent jurisdiction. The
9999 court in such action:
100100 (1) May award compensatory damages, injunctive relief, or any other
101101 appropriate relief to a prevailing party who establishes a violation of this section;
102102 and
103103 (2) Shall award court costs, expenses, and reasonable attorney fees to a
104104 prevailing party who establishes a violation of this section.
105105 (d) This section terminates on July 1, 2035.
106106 SECTION 6. The headings in this act are for reference purposes only and do not
107107 constitute a part of the law enacted by this act. However, the Tennessee Code Commission is
108108 requested to include the headings in any compilation or publication containing this act.
109109 SECTION 7. This act takes effect July 1, 2025, the public welfare requiring it.
