1313 AN ACT to amend Tennessee Code Annotated, Title 49,
1414 relative to physical activity for students.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 49-6-1021(a), is amended by
1818 deleting the subsection and substituting:
1919 (a) In accordance with ยง 49-6-1022, each LEA shall integrate:
2020 (1) For elementary school students, a minimum of sixty (60) minutes of
2121 physical activity per full school day; and
2222 (2) For middle and high school students, a minimum of ninety (90)
2323 minutes of physical activity per full school week.
2424 SECTION 2. Tennessee Code Annotated, Section 49-6-1021(b), is amended by
2525 deleting the subsection and substituting:
2626 (b)
2727 (1) Physical activity may include walking, jumping rope, playing
2828 volleyball, or other forms of physical activity that promote fitness and well-being.
2929 Walking to and from class is not physical activity for purposes of this section.
3030 (2) To satisfy the requirements of subdivision (a)(1):
3131 (A) Physical activity:
3232 (i) Must include unstructured play outside, unless weather
3333 conditions negatively impact reasonable execution of physical
3434 activity outside; and
3535 (ii) Does not include:

4040 (a) Time during which a student is permitted to use
4141 an electronic device; or
4242 (b) Time spent by a student in a physical education
4343 class;
4444 (B) An LEA shall offer elementary students two (2) thirty-minute
4545 periods of physical activity per school day, one (1) session occurring in
4646 the morning and one (1) session occurring in the afternoon; and
4747 (C) A student shall not be withheld from participating in physical
4848 activity as a form of punishment.
4949 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it.
