1312 AN ACT to amend Tennessee Code Annotated, Title 2 and
1413 Title 40, relative to voting rights.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 40-29-202, is amended by deleting
1817 subdivision (b)(2).
1918 SECTION 2. Tennessee Code Annotated, Section 40-29-202(c), is amended by
2019 deleting "unless the person is current in all child support obligations" and substituting "unless
2120 the person is compliant with all current child support orders, including orders related to child
2221 support arrearages".
2322 SECTION 3. Tennessee Code Annotated, Section 40-29-204, is amended by deleting
2423 the following language:
2524 Notwithstanding this part, the following persons shall never be eligible to register
2625 and vote in this state:
2726 and substituting instead:
2827 Notwithstanding this part, the following persons are ineligible to register and vote
2928 in this state, unless at least three (3) years have elapsed since the person's
3029 sentence completion date, and the person has met all other qualifications to
3130 restore their right of suffrage:
3231 SECTION 4. Tennessee Code Annotated, Section 40-29-105, is amended by deleting
3332 subdivision (b)(2) and substituting:
3433 (2) A person rendered infamous after July 1, 1986, by virtue of being convicted
3534 of first degree murder, aggravated rape, treason, or voter fraud is ineligible to register

40-and vote in this state unless at least three (3) years have elapsed since the person's
4140 sentence completion date, and the person has met all other qualifications to restore their
4241 right of suffrage.
4342 SECTION 5. Tennessee Code Annotated, Section 40-29-105(c)(2)(B), is amended by
4443 deleting the subdivision and substituting:
4544 (B) A person convicted of an infamous crime may petition for restoration upon
4645 the expiration of the maximum sentence imposed by the court for the infamous crime;
4746 provided, that a person convicted of murder, rape, treason, or voter fraud is ineligible to
4847 register and vote in this state unless at least three (3) years have elapsed since the
4948 person's sentence completion date, and the person has met all other qualifications to
5049 restore their right of suffrage;
5150 SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
