1313 AN ACT to amend Tennessee Code Annotated, Title 5;
1414 Title 6; Title 7 and Title 13, relative to zoning.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Title 13, Chapter 7, Part 1, is amended by
1818 adding the following as a new section:
1919 (a) As used in this section:
2020 (1) "Correctional facility" means a facility or institution that houses an
2121 inmate population under the jurisdiction of the department of correction, including
2222 privately and state managed correctional facilities;
2323 (2) "County" means a county or metropolitan form of government,
2424 including any consolidated government established pursuant to the power
2525 granted by the Constitution of Tennessee, Article XI, ยง 9;
2626 (3) "Facility" means a correctional facility, hospital, or nursing home;
2727 (4) "Hospital" means an institution that has been licensed, certified, or
2828 approved by the health facilities commission of the department of health as a
2929 hospital;
3030 (5) "Nursing home" means a licensed nursing home, assisted care living
3131 facility, or any other facility approved by the board for licensing health care
3232 facilities of the department of health as a nursing home, and includes any
3333 independent living facility on the same property as a licensed nursing home,
3434 assisted care living facility, or home for the aged; and

3939 (6) "One hundred-year flood plain" means the one-hundred-year
4040 floodway and that maximum area of land that is likely to be flooded by a one-
4141 hundred-year flood shown on flood plain maps approved or promulgated by the
4242 United States department of housing and urban development.
4343 (b) Notwithstanding the delegation of zoning authority to counties in this part to
4444 the contrary:
4545 (1) No facility shall be constructed in a designated one hundred-year
4646 flood plain;
4747 (2) No existing facility or a portion of an existing facility located in a
4848 designated one-hundred-year flood plain that was previously licensed as a
4949 correctional facility, hospital, or nursing home but has been vacated or used for
5050 other purposes may subsequently be licensed as a correctional facility, hospital,
5151 or nursing home; and
5252 (3) All access and required functional facility components shall be
5353 constructed above the designated one hundred-year flood plain in a new addition
5454 to an existing facility located in such a flood plain.
5555 SECTION 2. Tennessee Code Annotated, Title 13, Chapter 7, Part 2, is amended by
5656 adding the following as a new section:
5757 (a) As used in this section:
5858 (1) "Correctional facility" means a facility or institution that houses an
5959 inmate population under the jurisdiction of the department of correction, including
6060 privately and state managed correctional facilities;

6666 (3) "Hospital" means an institution that has been licensed, certified, or
6767 approved by the health facilities commission of the department of health as a
6868 hospital;
6969 (4) "Municipality" means and includes any city or town organized and
7070 operating under the general or special laws of the state;
7171 (5) "Nursing home" means a licensed nursing home, assisted care living
7272 facility, or any other facility approved by the board for licensing health care
7373 facilities of the department of health as a nursing home, and includes any
7474 independent living facility on the same property as a licensed nursing home,
7575 assisted care living facility, or home for the aged; and
7676 (6) "One hundred-year flood plain" means the one-hundred-year
7777 floodway and that maximum area of land that is likely to be flooded by a one-
7878 hundred-year flood shown on flood plain maps approved or promulgated by the
7979 United States department of housing and urban development.
8080 (b) Notwithstanding the delegation of zoning authority to municipalities in this
8181 part to the contrary:
8282 (1) No facility shall be constructed in a designated one hundred-year
8383 flood plain;
8484 (2) No existing facility or a portion of an existing facility located in a
8585 designated one-hundred-year flood plain that was previously licensed as a
8686 correctional facility, hospital, or nursing home but has been vacated or used for
8787 other purposes may subsequently be licensed as a correctional facility, hospital,

9393 (3) All access and required functional facility components shall be

9595 to an existing facility located in such a flood plain.
9696 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it, and
9797 applies to all applications for construction permits submitted on or after such date.
