16 | 16 | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: | |
17 | 17 | SECTION 1. Tennessee Code Annotated, Section 10-7-504(a)(22), is amended by | |
18 | 18 | deleting subdivision (D) and substituting: | |
19 | 19 | (D) | |
20 | 20 | (i) Survey records, responses, data, identifying information as defined in | |
21 | 21 | subdivision (a)(15), intra-agency and interagency communications, and other | |
22 | 22 | records received to serve as input for any survey created, obtained, or compiled | |
23 | 23 | by the comptroller of the treasury; provided, however, the comptroller may | |
24 | 24 | publish: | |
25 | 25 | (a) Aggregate survey data; and | |
26 | 26 | (b) Survey responses that cannot be used to identify individuals | |
27 | 27 | completing the survey. | |
28 | 28 | (ii) This subdivision (a)(22)(D) does not apply to a survey conducted by | |
29 | 29 | the office of open records counsel, created by ยง 8-4-601. | |
30 | 30 | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
