13+AN ACT to amend Tennessee Code Annotated, Section
14+12-3-1205, relative to cooperative purchasing.

1216 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1317 SECTION 1. Tennessee Code Annotated, Section 12-3-1205(b)(4)(B), is amended by
1418 deleting the subdivision and substituting instead:
1519 (B) Purchases of construction, engineering, or architectural services, or
16-construction materials. As used in this subdivision (b)(4)(8), "construction" and
20+construction materials. As used in this subdivision (b)(4)(B), "construction" and
1721 "construction materials" does not include:
1822 (i) Materials used in the operation of a municipal utility system, including,
1923 but not limited to, transformers, conductors, insulators, poles, cross-arms,
2024 anchors, pipes, valves, meters, or other components or parts of a utility system,
2125 whether purchased in accordance with a purchasing agreement with the
2226 Tennessee Valley authority or another purchasing arrangement; or
2327 (ii) Materials, labor, and services used for maintenance, operations,
2428 component replacement, or repairs of existing facilities and grounds owned or
2529 operated by a local education agency or by a local government agency; or
26-SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. HOUSE BILL NO. 546
