| 17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 18 | | SECTION 1. Tennessee Code Annotated, Section 8-16-306(b), is amended by deleting |
|---|
| 19 | 19 | | the language "and" in subdivision (1), by redesignating subdivision (2) as subdivision (3), and by |
|---|
| 20 | 20 | | adding the following as a new subdivision (2): |
|---|
| 21 | 21 | | (2) Completing a course of instruction concerning online notarization under |
|---|
| 22 | 22 | | subsection (e) and passing an examination administered by the course provider; and |
|---|
| 23 | 23 | | SECTION 2. Tennessee Code Annotated, Section 8-16-306(c)(7), is amended by |
|---|
| 24 | 24 | | deleting the subdivision and substituting instead the following: |
|---|
| 25 | 25 | | (7) A certification that the applicant has reviewed, understands, and will comply |
|---|
| 26 | 26 | | with the requirements of this part and the rules promulgated by the secretary of state |
|---|
| 27 | 27 | | under this part. |

| 28 | 28 | | SECTION 3. Tennessee Code Annotated, Section 8-16-306, is amended by adding the |
|---|
| 29 | 29 | | following as a new subsection (e): |

| 31 | 31 | | (1) The course of instruction on online notarization, as required under |
|---|
| 32 | 32 | | subdivision (b)(2), must cover, at a minimum: |
|---|
| 33 | 33 | | (A) Notarial laws; |
|---|
| 34 | 34 | | (B) Technology procedures of online notarizations; and |
|---|
| 35 | 35 | | (C) Ethical requirements for online notaries. |

| 43 | 43 | | SECTION 4. This act takes effect January 1, 2026, the public welfare requiring it. |
