15 | 15 | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: | |
16 | 16 | SECTION 1. Tennessee Code Annotated, Section 2-8-108, is amended by adding the | |
17 | 17 | following new subsections: | |
18 | 18 | (c) Each county election commission shall make election records available not | |
19 | 19 | later than the fifteenth day after election day in an electronic format for a fee of no more | |
20 | 20 | than fifty dollars ($50.00). | |
21 | 21 | (d) Beginning on the first day after the date the final certification of an election is | |
22 | 22 | completed, each county election commission shall make available for public inspection | |
23 | 23 | election records that are: | |
24 | 24 | (1) Images of voted ballots, if a county maintains images of voted ballots; | |
25 | 25 | or | |
26 | 26 | (2) Cast vote records. | |
27 | 27 | (e) Beginning on the sixty-first day after an election, each county election | |
28 | 28 | commission shall make available for public inspection records that are original voted | |
29 | 29 | ballots. The coordinator of elections shall adopt procedures to ensure the redaction of | |
30 | 30 | any personally identifiable information of the voter contained on a ballot before marking | |
31 | 31 | the voted ballot available for public inspection. | |
32 | 32 | (f) A person making a request pursuant to subsections (c)-(e) may observe the | |
33 | 33 | scanning and related handling process, but shall not touch or handle a physical ballot. | |
34 | 34 | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
