16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 56-7-2328(a), is amended by |
---|
18 | 18 | | deleting the subsection and substituting: |
---|
19 | 19 | | (a) As used in this section: |
---|
20 | 20 | | (1) "Contraceptive" means any device, medication, biological product, or |
---|
21 | 21 | | procedure that is intended for use in the prevention of pregnancy, whether |
---|
22 | 22 | | specifically intended to prevent pregnancy or for other health needs; |
---|
23 | 23 | | (2) "Health benefit plan": |
---|
24 | 24 | | (A) Means a hospital, surgical, or medical expense policy; health, |
---|
25 | 25 | | hospital, or medical service corporation contract; a policy or agreement |
---|
26 | 26 | | entered into by a health insurer, or a health maintenance organization |
---|
27 | 27 | | contract offered by an employer; other plan administered by the state; or |
---|
28 | 28 | | a certificate issued under those policies, contracts, or plans; and |
---|
29 | 29 | | (B) Includes a policy or contract for health insurance coverage |
---|
30 | 30 | | provided under: |
---|
31 | 31 | | (i) The TennCare program administered under the Medical |
---|
32 | 32 | | Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a |
---|
33 | 33 | | successor medicaid program; or |
---|
34 | 34 | | (ii) The CoverKids Act of 2006, compiled in title 71, |
---|
35 | 35 | | chapter 3, part 11, or a successor program; and |
---|

41 | 41 | | (C) Does not include policies or certificates covering only |

42 | 42 | | accident, credit, dental, disability income, long-term care, hospital |

43 | 43 | | indemnity, medicare supplement as defined in § 1882(g)(1) of the Social |

44 | 44 | | Security Act (42 U.S.C. § 1395ss(g)(1)), specified disease, vision care, |
---|
45 | 45 | | other limited benefit health insurance, coverage issued as a supplement |
---|
46 | 46 | | to liability insurance, workers' compensation insurance, automobile |
---|
47 | 47 | | medical payment insurance, or insurance under which benefits are |
---|
48 | 48 | | payable with or without regard to fault and that is statutorily required to be |
---|
49 | 49 | | contained in a liability insurance policy or equivalent self-insurance; |
---|
50 | 50 | | (3) "Health insurance entity" has the same meaning as defined in § 56-7- |
---|
51 | 51 | | 109 and includes a managed care organization contracting with the state to |
---|
52 | 52 | | provide insurance through: |
---|
53 | 53 | | (A) The TennCare program administered under the Medical |
---|
54 | 54 | | Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a |
---|
55 | 55 | | successor medicaid program; or |
---|
56 | 56 | | (B) The CoverKids program administered under the CoverKids |
---|
57 | 57 | | Act of 2006, compiled in title 71, chapter 3, part 11, or a successor |
---|
58 | 58 | | program; and |
---|
59 | 59 | | (4) "Healthcare provider" and "provider" mean a person or entity that |
---|
60 | 60 | | provides healthcare services; is registered, certified, or licensed in accordance |
---|
61 | 61 | | with title 63; and is regulated under the department of health or the division of |
---|
62 | 62 | | health-related boards. |

63 | 63 | | SECTION 2. Tennessee Code Annotated, Section 56-7-2328(b), is amended by |
---|
64 | 64 | | deleting "July 1, 2024" and substituting "January 1, 2026". |
