| 16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 17 | 17 | | SECTION 1. This act is known and may be cited as "Tucker's Law." |
|---|
| 18 | 18 | | SECTION 2. Tennessee Code Annotated, Title 49, Chapter 6, Part 10, is amended by |
|---|
| 19 | 19 | | adding the following as a new section: |
|---|
| 20 | 20 | | (a) The month of October is designated as "Fentanyl Poisoning Awareness |
|---|
| 21 | 21 | | Month" in all public schools to educate students about the dangers posed by the drug |
|---|
| 22 | 22 | | fentanyl and the risks of fentanyl poisoning, including overdose. |
|---|
| 23 | 23 | | (b) During Fentanyl Poisoning Awareness Month, each LEA and public charter |
|---|
| 24 | 24 | | school shall provide age-appropriate, research-based instruction related to fentanyl |
|---|
| 25 | 25 | | abuse prevention and drug poisoning awareness to students in grades six through |
|---|
| 26 | 26 | | twelve (6-12). |
|---|
| 27 | 27 | | (c) The instruction required pursuant to subsection (b) must include: |
|---|
| 28 | 28 | | (1) Suicide prevention; |
|---|
| 29 | 29 | | (2) Prevention of the abuse of and addiction to fentanyl; |
|---|
| 30 | 30 | | (3) Awareness of local school and community resources and any |
|---|
| 31 | 31 | | processes involved in accessing those resources; and |
|---|
| 32 | 32 | | (4) Health education that includes information about substance use and |
|---|
| 33 | 33 | | abuse, including youth substance use and abuse. |
|---|
| 34 | 34 | | (d) The instruction required pursuant to subsection (b) may be provided by an |
|---|
| 35 | 35 | | entity or an employee or agent of an entity that is: |

| 36 | 36 | | |
|---|

|---|
| 40 | 40 | | (1) A public or private institution of higher education; |
|---|
| 41 | 41 | | (2) A library; |
|---|
| 42 | 42 | | (3) A community service organization; |
|---|
| 43 | 43 | | (4) A religious organization; |
|---|
| 44 | 44 | | (5) A local public health agency; or |
|---|
| 45 | 45 | | (6) An organization employing mental health professionals. |
|---|
| 46 | 46 | | SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it. |
