17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Section 49-50-1001(b)(2), is amended by |
---|
19 | 19 | | deleting the subdivision and substituting the following: |
---|
20 | 20 | | (2) Subject to Section 2, determine the salary and terms of employment for |
---|
21 | 21 | | employees of state special schools; |
---|
22 | 22 | | SECTION 2. Tennessee Code Annotated, Section 49-50-1001, is amended by adding |
---|
23 | 23 | | the following as a new, appropriately designated subsection: |
---|
24 | 24 | | (1) In managing and controlling the state special schools, the department of |
---|
25 | 25 | | education must provide the following to the teachers of state special schools: |
---|
26 | 26 | | (A) Eligibility to accumulate and use leave in the same manner as public |
---|
27 | 27 | | school teachers under chapter 5, part 7 of this title; and |
---|
28 | 28 | | (B) Eligibility for paid family leave in accordance with ยง 8-50-814. |
---|
29 | 29 | | (2) As used in this subsection ( ), "teacher": |
---|
30 | 30 | | (A) Means a person licensed by the state board of education and |
---|
31 | 31 | | employed at a state special school; and |
---|
32 | 32 | | (B) Does not include: |
---|
33 | 33 | | (i) The chief administrative officer of a state special school; and |
---|
34 | 34 | | (ii) Those who are considered state employees for leave |
---|
35 | 35 | | purposes under title 8, chapter 50, part 8. |

40 | 40 | | SECTION 3. Tennessee Code Annotated, Section 49-50-1003, is amended by adding |
---|
41 | 41 | | the following new subsections: |
---|
42 | 42 | | (e) Any percentage increase to the salary schedule of an LEA where a state |
---|
43 | 43 | | special school is located must also result in an equivalent percentage increase to the |
---|
44 | 44 | | salary schedule for that state special school. |
---|
45 | 45 | | (f) When the general assembly appropriates monies in the budget for salaries, |
---|
46 | 46 | | raises, bonuses, or other incentives for public school teachers and other licensed |
---|
47 | 47 | | personnel employed in an LEA or public charter school in this state, the department of |
---|
48 | 48 | | education shall also obligate and expend appropriations in an equivalent amount for |
---|
49 | 49 | | salaries, raises, bonuses, or other incentives for the teachers and other licensed |
---|
50 | 50 | | personnel employed in the state special schools managed and controlled by the |
---|
51 | 51 | | department of education. It is the legislative intent that the general assembly will |
---|
52 | 52 | | appropriate monies in a sufficient amount to effectuate this subsection (f). The state is |
---|
53 | 53 | | not prohibited from providing the teachers and other licensed personnel employed in the |
---|
54 | 54 | | state special schools more than what is required by this part. |
---|
55 | 55 | | SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it, and |
---|
56 | 56 | | applies to the 2025-2026 school year and each school year thereafter. |
