1313 AN ACT to amend Tennessee Code Annotated,
1414 Title 8, Chapter 50 and Title 49, relative to
1515 employees of state special schools.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Section 49-50-1001(b)(2), is amended by
1919 deleting the subdivision and substituting the following:
2020 (2) Subject to Section 2, determine the salary and terms of employment for
2121 employees of state special schools;
2222 SECTION 2. Tennessee Code Annotated, Section 49-50-1001, is amended by adding
2323 the following as a new, appropriately designated subsection:
2424 (1) In managing and controlling the state special schools, the department of
2525 education must provide the following to the teachers of state special schools:
2626 (A) Eligibility to accumulate and use leave in the same manner as public
2727 school teachers under chapter 5, part 7 of this title; and
2828 (B) Eligibility for paid family leave in accordance with ยง 8-50-814.
2929 (2) As used in this subsection ( ), "teacher":
3030 (A) Means a person licensed by the state board of education and
3131 employed at a state special school; and
3232 (B) Does not include:
3333 (i) The chief administrative officer of a state special school; and
3434 (ii) Those who are considered state employees for leave
3535 purposes under title 8, chapter 50, part 8.

4040 SECTION 3. Tennessee Code Annotated, Section 49-50-1003, is amended by adding
4141 the following new subsections:
4242 (e) Any percentage increase to the salary schedule of an LEA where a state
4343 special school is located must also result in an equivalent percentage increase to the
4444 salary schedule for that state special school.
4545 (f) When the general assembly appropriates monies in the budget for salaries,
4646 raises, bonuses, or other incentives for public school teachers and other licensed
4747 personnel employed in an LEA or public charter school in this state, the department of
4848 education shall also obligate and expend appropriations in an equivalent amount for
4949 salaries, raises, bonuses, or other incentives for the teachers and other licensed
5050 personnel employed in the state special schools managed and controlled by the
5151 department of education. It is the legislative intent that the general assembly will
5252 appropriate monies in a sufficient amount to effectuate this subsection (f). The state is
5353 not prohibited from providing the teachers and other licensed personnel employed in the
5454 state special schools more than what is required by this part.
5555 SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it, and
5656 applies to the 2025-2026 school year and each school year thereafter.
