12	12	AN ACT to amend Tennessee Code Annotated, Title 2,
13	13	relative to voting.

15	15	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
16	16	SECTION 1. Tennessee Code Annotated, Section 2-7-112(a)(1), is amended by
17	17	deleting the subdivision and substituting instead:
18	18	(A) A voter shall complete and sign an application for ballot, indicate the primary
19	19	in which the voter desires to vote, if any, and present it to a precinct registrar. The
20	20	application for ballot must include a space for the address of the voter's current
21	21	residence, and the voter shall write or print such address on the application when the
22	22	voter signs the application for ballot.
23	23	(B) At the time a voter presents an application for ballot, the voter shall present
24	24	to the precinct registrar one (1) form of identification for voter identification that bears the
25	25	name and photograph and residential address of the voter. The requirement to present
26	26	one (1) form of identification that bears the name and photograph and residential
27	27	address of the voter applies to persons voting pursuant to § 2-6-109; provided, however,
28	28	that a person voting in accordance with § 2-6-401(a) and (b) or § 2-6-601 is not required
29	29	to show an identification with a photograph and residential address of the voter.
30	30	(C) For purposes of verifying the person's identification on the application for
31	31	ballot, "form of identification for voter identification" must:
32	32	(i) Have been obtained with documented proof of citizenship of the
33	33	United States;
34	34	(ii) Include the voter's photograph, current residential address, and
35	35	expiration date of the identification;

40	40	(iii) Indicate that the individual meets eligibility requirements for voting,
41	41	including citizenship of the United States;
42	42	(iv) Accommodate for the permanently disabled and include a process for
43	43	permanent identification; and
44	44	(v) Not be an identification card issued to a student by an institution of
45	45	higher education.
46	46	(D) Using the computerized voter signature list or the electronic poll book, the
47	47	registrar shall make a determination whether the voter's address is different from the
48	48	address on the voter's permanent registration record or if the registration is in inactive
49	49	status. If the voter has changed residence, or the voter's registration is inactive, the
50	50	registrar shall follow the procedures for voting pursuant to §§ 2-7-140 and 2-7-141.
51	51	(E) If, upon verification of evidence of identification, it is found that the applicant
52	52	is entitled to vote, the registrar shall initial the application, note the date of the election,
53	53	the number on the voter's ballot application, and the primary or general election in which
54	54	the voter applies to vote.
55	55	(F) If the applicant's signature is illegible, the registrar shall print the name on the
56	56	application.
57	57	(G) The state coordinator of elections shall promulgate rules for training all
58	58	election commissioners, election employees, election officials, and poll workers for
59	59	procedures at the polls.
60	60	(H) The state coordinator of elections, in concurrence with the secretary of state,
61	61	shall provide public access to information regarding how to obtain and the proper use of
62	62	voter identification as required for the procedures to vote.
63	63	SECTION 2. Tennessee Code Annotated, Section 2-7-112(c), is amended by deleting
64	64	the subsection.

69	69	SECTION 3. Tennessee Code Annotated, Section 2-7-112(a)(3)(A)(vi), is amended by
70	70	deleting the language "punchcard or".
71	71	SECTION 4. Tennessee Code Annotated, Section 2-7-112(a)(3)(B)(i), is amended by
72	72	deleting the following language:
73	73	When provisional ballots have been cast utilizing punchcard or optiscan
74	74	technology, the counting of the provisional ballots shall be pursuant to rules
75	75	promulgated by the state coordinator of elections.
76	76	and substituting instead:
77	77	When provisional ballots have been cast utilizing a paper ballot, either marked by
78	78	hand or a ballot-marking device, and tabulated by optical scan technology, the
79	79	counting of the provisional ballots must be pursuant to rules promulgated by the
80	80	state coordinator of elections.
81	81	SECTION 5. Tennessee Code Annotated, Section 2-7-112(d), is amended by deleting
82	82	the subsection and substituting instead:
83	83	(d) For purposes of processing the voter's application to vote pursuant to
84	84	subdivision (a)(3), "verification of residential address" includes, but is not limited to, a
85	85	Tennessee driver license, a residential lease agreement, a utility bill, or other document
86	86	bearing the applicant's residential address. The "verification of residential address" must
87	87	not include a digital source or sources. Such verification may be on the same or
88	88	different identification from those listed in subsection (a).
89	89	SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
