1212 AN ACT to amend Tennessee Code Annotated, Title 2,
1313 relative to voting.

1515 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1616 SECTION 1. Tennessee Code Annotated, Section 2-7-112(a)(1), is amended by
1717 deleting the subdivision and substituting instead:
1818 (A) A voter shall complete and sign an application for ballot, indicate the primary
1919 in which the voter desires to vote, if any, and present it to a precinct registrar. The
2020 application for ballot must include a space for the address of the voter's current
2121 residence, and the voter shall write or print such address on the application when the
2222 voter signs the application for ballot.
2323 (B) At the time a voter presents an application for ballot, the voter shall present
2424 to the precinct registrar one (1) form of identification for voter identification that bears the
2525 name and photograph and residential address of the voter. The requirement to present
2626 one (1) form of identification that bears the name and photograph and residential
2727 address of the voter applies to persons voting pursuant to § 2-6-109; provided, however,
2828 that a person voting in accordance with § 2-6-401(a) and (b) or § 2-6-601 is not required
2929 to show an identification with a photograph and residential address of the voter.
3030 (C) For purposes of verifying the person's identification on the application for
3131 ballot, "form of identification for voter identification" must:
3232 (i) Have been obtained with documented proof of citizenship of the
3333 United States;
3434 (ii) Include the voter's photograph, current residential address, and
3535 expiration date of the identification;

4040 (iii) Indicate that the individual meets eligibility requirements for voting,
4141 including citizenship of the United States;
4242 (iv) Accommodate for the permanently disabled and include a process for
4343 permanent identification; and
4444 (v) Not be an identification card issued to a student by an institution of
4545 higher education.
4646 (D) Using the computerized voter signature list or the electronic poll book, the
4747 registrar shall make a determination whether the voter's address is different from the
4848 address on the voter's permanent registration record or if the registration is in inactive
4949 status. If the voter has changed residence, or the voter's registration is inactive, the
5050 registrar shall follow the procedures for voting pursuant to §§ 2-7-140 and 2-7-141.
5151 (E) If, upon verification of evidence of identification, it is found that the applicant
5252 is entitled to vote, the registrar shall initial the application, note the date of the election,
5353 the number on the voter's ballot application, and the primary or general election in which
5454 the voter applies to vote.
5555 (F) If the applicant's signature is illegible, the registrar shall print the name on the
5656 application.
5757 (G) The state coordinator of elections shall promulgate rules for training all
5858 election commissioners, election employees, election officials, and poll workers for
5959 procedures at the polls.
6060 (H) The state coordinator of elections, in concurrence with the secretary of state,
6161 shall provide public access to information regarding how to obtain and the proper use of
6262 voter identification as required for the procedures to vote.
6363 SECTION 2. Tennessee Code Annotated, Section 2-7-112(c), is amended by deleting
6464 the subsection.

6969 SECTION 3. Tennessee Code Annotated, Section 2-7-112(a)(3)(A)(vi), is amended by
7070 deleting the language "punchcard or".
7171 SECTION 4. Tennessee Code Annotated, Section 2-7-112(a)(3)(B)(i), is amended by
7272 deleting the following language:
7373 When provisional ballots have been cast utilizing punchcard or optiscan
7474 technology, the counting of the provisional ballots shall be pursuant to rules
7575 promulgated by the state coordinator of elections.
7676 and substituting instead:
7777 When provisional ballots have been cast utilizing a paper ballot, either marked by
7878 hand or a ballot-marking device, and tabulated by optical scan technology, the
7979 counting of the provisional ballots must be pursuant to rules promulgated by the
8080 state coordinator of elections.
8181 SECTION 5. Tennessee Code Annotated, Section 2-7-112(d), is amended by deleting
8282 the subsection and substituting instead:
8383 (d) For purposes of processing the voter's application to vote pursuant to
8484 subdivision (a)(3), "verification of residential address" includes, but is not limited to, a
8585 Tennessee driver license, a residential lease agreement, a utility bill, or other document
8686 bearing the applicant's residential address. The "verification of residential address" must
8787 not include a digital source or sources. Such verification may be on the same or
8888 different identification from those listed in subsection (a).
8989 SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
