1312 AN ACT to amend Tennessee Code Annotated, Title 12,
1413 Chapter 3, relative to public purchases.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 12-3-201(8)(B), is amended by
1817 deleting subdivision (8)(B) and substituting:

2019 (B) "Goods" also means all improvements to real property, including, but
2120 not limited to, buildings, structures, equipment, fixtures, and anything else
2221 permanently attached to real property, but does not include real property;
2322 SECTION 2. Tennessee Code Annotated, Section 12-3-1201(c), is amended by
2423 deleting the subsection and substituting:
2524 (c) To the extent permitted by federal law or regulations, local governments may
2625 make purchases of:
2726 (1) Goods, except motor vehicles other than those manufactured for a
2827 special purpose as defined in ยง 12-3-1208, or services included in federal
2928 general service administration contracts or other applicable federal open
3029 purchase contracts either directly or through the appropriate state agency;
3130 provided, that no purchase under this section shall be made at a price higher
3231 than that which is contained in the contract between the general services
3332 administration and the vendor affected; and
3433 (2) Goods and services directly, without bid or quotations, from vendors
3534 awarded general services administration (GSA) schedule contracts at prices
35+equal to the vendor's current GSA schedule price. The terms and conditions

40-equal to the vendor's current GSA schedule price. The terms and conditions
4140 agreeable to a local government may be used in lieu of the GSA terms and
4241 conditions in such purchases.
4342 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
