13	13	AN ACT to amend Tennessee Code Annotated, Title 49,
14	14	relative to higher education.

16	16	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
17	17	SECTION 1. Tennessee Code Annotated, Section 49-4-708(b)(3), is amended by
18	18	adding the following as a new subdivision (C):
19	19	(C) An institution accredited by the National Accrediting Commission of Career
20	20	Arts and Sciences (NACCAS) that has its primary campus domiciled in this state;
21	21	SECTION 2. Tennessee Code Annotated, Section 49-4-708(b)(1), is amended by
22	22	adding the language "or an eligible postsecondary institution, as defined in subdivision
23	23	(b)(3)(C)," after "Tennessee college of applied technology".
24	24	SECTION 3. Tennessee Code Annotated, Section 49-4-708(b)(4), is amended by
25	25	designating subdivision (B) as subdivision (C) and adding the following as subdivision (B):
26	26	(B) Includes, beginning with the fall semester of the 2025-2026 academic year, a
27	27	curriculum of courses leading to a certificate, diploma, or other credential at an eligible
28	28	postsecondary institution, as defined in subdivision (b)(3)(C);
29	29	SECTION 4. Tennessee Code Annotated, Section 49-4-708(b)(5), is amended by
30	30	adding the language "or eligible postsecondary institution, as defined in subdivision (b)(3)(C)"
31	31	after "Tennessee college of applied technology".
32	32	SECTION 5. Tennessee Code Annotated, Section 49-4-708(c)(3), is amended by
33	33	adding the language "or eligible postsecondary institution, as defined in subdivision (b)(3)(C)"

39	39	SECTION 6. Tennessee Code Annotated, Section 49-4-708(c), is amended by deleting
40	40	subdivisions (5) and (6) and substituting instead the following:
41	41	(5) A Tennessee Promise scholarship:
42	42	(A) At a Tennessee public two-year postsecondary institution or
43	43	Tennessee college of applied technology is the cost of tuition and mandatory
44	44	fees at the eligible postsecondary institution attended less all other gift aid. Gift
45	45	aid must be credited first to the student's tuition and mandatory fees; or
46	46	(B) At an eligible four-year public postsecondary institution or an eligible
47	47	private institution, which includes an eligible postsecondary institution, as defined
48	48	in subdivision (b)(3)(C), is the average cost of tuition and mandatory fees at the
49	49	public two-year postsecondary institutions less all other gift aid. Gift aid must be
50	50	credited first to the student's tuition and mandatory fees;
51	51	SECTION 7. Tennessee Code Annotated, Section 49-4-708(c), is amended by adding
52	52	the following as a new subdivision:
53	53	(12) Notwithstanding this subsection (c) to the contrary, to be eligible for the
54	54	scholarship at an eligible postsecondary institution, as defined in subdivision (b)(3)(C),
55	55	TSAC must first determine that there are no available enrollment slots at a Tennessee
56	56	college of applied technology in the county in which the student resides for the student's
57	57	desired program of study. If there are available enrollment slots at a Tennessee college
58	58	of applied technology in the county in which the student resides for the student's desired
59	59	program of study, then the student must be enrolled in a Tennessee college of applied
60	60	technology in order to receive the scholarship.
61	61	SECTION 8. This act takes effect July 1, 2025, the public welfare requiring it, and
62	62	applies to Tennessee Promise scholarships awarded for the 2025-2026 academic year and
63	63	each academic year thereafter.
