13	13	AN ACT to amend Tennessee Code Annotated, Title 4,
14	14	Chapter 3; Title 4, Chapter 49; Section 9-16-101;
15	15	Title 54, Chapter 4; Title 55, Chapter 4; Title 57,
16	16	Chapter 5, Part 2; Title 57, Chapter 3, Part 3; Title
17	17	67, Chapter 3, Part 9; Title 67, Chapter 4, Part 9
18	18	and Title 67, relative to allocations to counties and
19	19	municipalities.

21	21	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
22	22	SECTION 1. Tennessee Code Annotated, Section 67-6-103(a)(3)(A), is amended by
23	23	adding the language "and according to subdivision (a)(3)(G)" immediately after the language
24	24	"according to the latest federal census and other censuses authorized by law".
25	25	SECTION 2. Tennessee Code Annotated, Section 67-6-103(a)(3), is amended by
26	26	adding the following as a new subdivision (G):
27	27	Notwithstanding the right or ability of a county or municipality to take a special
28	28	census at any time during the interim between the regular decennial federal census
29	29	under this section or another law, the department of economic and community
30	30	development shall revise and certify the population of each county and municipality, and
31	31	the aggregate population of the state, prior to July 1 each year during the interim
32	32	between the regular decennial federal census according to this subdivision (a)(3)(G) for
33	33	purposes of ensuring equitable allocation and distribution of moneys under this
34	34	subdivision (a)(3). The Boyd Center for Business and Economic Research at the
35	35	University of Tennessee, through the Tennessee state data center, shall generate
36	36	annual population estimates for each county and municipality and provide the estimates
37	37	to the department of economic and community development for review and certification.
38	38	Prior to July 1, the department of economic and community development shall provide

43	43	the revised, certified populations of each county and municipality to the department of
44	44	revenue and the department of finance and administration. The allocation and
45	45	distribution of moneys pursuant to this subdivision (a)(3) must be made according to the
46	46	revised populations certified under this subdivision (a)(3)(G), except in instances where
47	47	a jurisdiction's population is revised as a result of a special census or in a year in which
48	48	populations are revised as a result of the regular decennial federal census.
49	49	SECTION 3. Tennessee Code Annotated, Section 67-6-103(j)(4), is amended by adding
50	50	the language "or according to subdivision (a)(3)(G)" immediately after the language "according
51	51	to the latest federal census or other censuses authorized by law".
52	52	SECTION 4. Tennessee Code Annotated, Title 4, Chapter 3, Part 7, is amended by
53	53	adding the following as a new section:
54	54	4-3-710.
55	55	(a) Notwithstanding the right or ability of a county or municipality to take a
56	56	special census during the interim between the regular decennial federal census, the
57	57	department of economic and community development shall revise and certify the
58	58	population of each county and municipality, and the aggregate population of the state,
59	59	prior to July 1 each year during the interim between the regular decennial federal census
60	60	according to this section for purposes of ensuring equitable population-based allocation
61	61	and distribution of moneys to counties and municipalities.
62	62	(b) The Boyd Center for Business and Economic Research at the University of

77	77	SECTION 5. Tennessee Code Annotated, Title 67, Chapter 1, Part 1, is amended by
78	78	adding the following as a new section:
79	79	67-1-119.
80	80	Notwithstanding another law to the contrary, the allocation and distribution of
81	81	moneys to counties and municipalities under this title, title 54, title 55, or title 57 based
82	82	on population must be made according to the revised populations certified by the
83	83	department of economic and community development under § 4-3-710, except in
84	84	instances where a jurisdiction's population is revised as a result of a special census or in
85	85	a year in which populations are revised as a result of the regular decennial federal
86	86	census.
87	87	SECTION 6. Tennessee Code Annotated, Title 4, Chapter 3, Part 10, is amended by
88	88	adding the following as a new section:
89	89	4-3-1015.
90	90	Except as otherwise expressly provided by law, the allocation and distribution of
91	91	moneys to counties and municipalities based on population must be made according to
92	92	the revised populations certified by the department of economic and community
93	93	development under § 4-3-710, except in instances where a jurisdiction's population is
94	94	revised as a result of a special census or in a year in which populations are revised as a
95	95	result of the regular decennial federal census.

100	100	SECTION 7. Tennessee Code Annotated, Section 4-49-104(e)(2), is amended by
101	101	addling the following language at the end of the subdivision:
102	102	Notwithstanding another law to the contrary, the allocation and distribution of moneys to
103	103	counties and municipalities under this subdivision (e)(2) must be made according to the
104	104	revised populations certified by the department of economic and community
105	105	development under § 4-3-710, except in instances where a jurisdiction's population is
106	106	revised as a result of a special census or in a year in which populations are revised as a
107	107	result of the regular decennial federal census.
108	108	SECTION 8. This act takes effect January 1, 2026, the public welfare requiring it.
