1313 AN ACT to amend Tennessee Code Annotated, Title 4,
1414 Chapter 3; Title 4, Chapter 49; Section 9-16-101;
1515 Title 54, Chapter 4; Title 55, Chapter 4; Title 57,

2121 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
2222 SECTION 1. Tennessee Code Annotated, Section 67-6-103(a)(3)(A), is amended by
2323 adding the language "and according to subdivision (a)(3)(G)" immediately after the language
2424 "according to the latest federal census and other censuses authorized by law".
2525 SECTION 2. Tennessee Code Annotated, Section 67-6-103(a)(3), is amended by
2626 adding the following as a new subdivision (G):
2727 Notwithstanding the right or ability of a county or municipality to take a special
2828 census at any time during the interim between the regular decennial federal census
2929 under this section or another law, the department of economic and community
3030 development shall revise and certify the population of each county and municipality, and
3131 the aggregate population of the state, prior to July 1 each year during the interim
3232 between the regular decennial federal census according to this subdivision (a)(3)(G) for
3333 purposes of ensuring equitable allocation and distribution of moneys under this
3434 subdivision (a)(3). The Boyd Center for Business and Economic Research at the
3535 University of Tennessee, through the Tennessee state data center, shall generate
3636 annual population estimates for each county and municipality and provide the estimates
3737 to the department of economic and community development for review and certification.
3838 Prior to July 1, the department of economic and community development shall provide

4343 the revised, certified populations of each county and municipality to the department of
4444 revenue and the department of finance and administration. The allocation and
4545 distribution of moneys pursuant to this subdivision (a)(3) must be made according to the
4646 revised populations certified under this subdivision (a)(3)(G), except in instances where
4747 a jurisdiction's population is revised as a result of a special census or in a year in which
4848 populations are revised as a result of the regular decennial federal census.
4949 SECTION 3. Tennessee Code Annotated, Section 67-6-103(j)(4), is amended by adding
5050 the language "or according to subdivision (a)(3)(G)" immediately after the language "according
5151 to the latest federal census or other censuses authorized by law".
5252 SECTION 4. Tennessee Code Annotated, Title 4, Chapter 3, Part 7, is amended by
5353 adding the following as a new section:
5454 4-3-710.
5555 (a) Notwithstanding the right or ability of a county or municipality to take a
5656 special census during the interim between the regular decennial federal census, the
5757 department of economic and community development shall revise and certify the
5858 population of each county and municipality, and the aggregate population of the state,
5959 prior to July 1 each year during the interim between the regular decennial federal census
6060 according to this section for purposes of ensuring equitable population-based allocation
6161 and distribution of moneys to counties and municipalities.
6262 (b) The Boyd Center for Business and Economic Research at the University of
6363 Tennessee, through the Tennessee state data center, shall generate annual population
6464 estimates for each county and municipality and provide the estimates to the department
6565 of economic and community development for review and certification.
6666 (c) Prior to July 1, the department of economic and community development
6767 shall provide the revised, certified populations of each county and municipality to the

7777 SECTION 5. Tennessee Code Annotated, Title 67, Chapter 1, Part 1, is amended by
7878 adding the following as a new section:

8080 Notwithstanding another law to the contrary, the allocation and distribution of
8181 moneys to counties and municipalities under this title, title 54, title 55, or title 57 based
8282 on population must be made according to the revised populations certified by the
8383 department of economic and community development under § 4-3-710, except in
8484 instances where a jurisdiction's population is revised as a result of a special census or in
8585 a year in which populations are revised as a result of the regular decennial federal
8686 census.
8787 SECTION 6. Tennessee Code Annotated, Title 4, Chapter 3, Part 10, is amended by
8888 adding the following as a new section:
8989 4-3-1015.
9090 Except as otherwise expressly provided by law, the allocation and distribution of
9191 moneys to counties and municipalities based on population must be made according to
9292 the revised populations certified by the department of economic and community
9393 development under § 4-3-710, except in instances where a jurisdiction's population is
9494 revised as a result of a special census or in a year in which populations are revised as a
9595 result of the regular decennial federal census.

100100 SECTION 7. Tennessee Code Annotated, Section 4-49-104(e)(2), is amended by
101101 addling the following language at the end of the subdivision:
102102 Notwithstanding another law to the contrary, the allocation and distribution of moneys to
103103 counties and municipalities under this subdivision (e)(2) must be made according to the
104104 revised populations certified by the department of economic and community
105105 development under § 4-3-710, except in instances where a jurisdiction's population is
106106 revised as a result of a special census or in a year in which populations are revised as a
107107 result of the regular decennial federal census.
108108 SECTION 8. This act takes effect January 1, 2026, the public welfare requiring it.
