1212 AN ACT to amend Tennessee Code Annotated, Title 39
1313 and Title 40, relative to expunction of certain
1414 offenses.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 40-32-101(g)(2)(B), is amended by
1818 deleting the subdivision and substituting instead:
1919 (B) At the time of the filing of the petition for expunction at least:
2020 (i) Three (3) years have elapsed since the completion of the sentence
2121 imposed for the offense the person is seeking to have expunged, if the offense is
2222 a misdemeanor or Class E felony;
2323 (ii) Six (6) years have elapsed since the completion of the sentence
2424 imposed for the offense the person is seeking to have expunged, if the offense is
2525 a Class D felony; or
2626 (iii) Ten (10) years have elapsed since the completion of the sentence
2727 imposed for the offense the person is seeking to have expunged, if the offense is
2828 a Class C felony; and
2929 SECTION 2. Tennessee Code Annotated, Section 40-32-101(k)(1)(C), is amended by
3030 deleting the subdivision and substituting:
3131 (C) At the time of the filing of the petition for expunction at least:
3232 (i) Three (3) years have elapsed since the completion of the sentence
3333 imposed for the most recent offense, if the offenses were both misdemeanors or

4040 imposed for the most recent offense, if one (1) of the offenses was a Class D
4141 felony; or
4242 (iii) Ten (10) years have elapsed since the completion of the sentence
4343 imposed for the most recent offense, if one (1) of the offenses was a Class C
4444 felony;
4545 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it.
