14 | 14 | | Title 3, relative to the general assembly. |

16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Title 3, Chapter 1, is amended by adding the |
---|
18 | 18 | | following language as a new part: |
---|
19 | 19 | | 3-1-301. The general assembly shall convene for a September session on the |
---|
20 | 20 | | Tuesday immediately following Labor Day in each odd-numbered year and shall adjourn |
---|
21 | 21 | | no later than September 30 of the same year. |
---|
22 | 22 | | 3-1-302. At the conclusion of the first annual session of each general assembly, |
---|
23 | 23 | | the adjournment resolution must provide that the general assembly will reconvene at |
---|
24 | 24 | | twelve o'clock (12:00) noon central daylight time (CDT) on the Tuesday immediately |
---|
25 | 25 | | following Labor Day in September of each odd-numbered year. |
---|
26 | 26 | | 3-1-303. |
---|
27 | 27 | | (a) Notwithstanding any rule of the senate or house of representatives to |
---|
28 | 28 | | the contrary, this part governs the biennial September sessions of the general |
---|
29 | 29 | | assembly. |
---|
30 | 30 | | (b) All procedural provisions of this title and all rules of the senate and |
---|
31 | 31 | | house of representatives not inconsistent with this part are applicable to biennial |
---|
32 | 32 | | September sessions of the general assembly. |
---|
33 | 33 | | (c) The committee on rules for each house shall meet prior to the |
---|
34 | 34 | | Thursday following Labor Day in September of each odd-numbered year to |
---|

39 | 39 | | consider additional rule amendments and suspensions necessary for the |
---|
40 | 40 | | effective and efficient operation of the September session. |

41 | 41 | | (d) The September session must be funded through the existing budget |
---|
42 | 42 | | for the general assembly's legislative session. |
---|
43 | 43 | | 3-1-304. |
---|
44 | 44 | | (a) During the September session, the general assembly may consider |
---|
45 | 45 | | the following: |
---|
46 | 46 | | (1) All bills and resolutions filed prior to adjournment of the first |
---|
47 | 47 | | annual session of the general assembly; |
---|
48 | 48 | | (2) Ninety-nine (99) bills and resolutions filed for the September |
---|
49 | 49 | | session of the general assembly in accordance with subsection (b); and |
---|
50 | 50 | | (3) Other matters deemed appropriate and necessary by the |
---|
51 | 51 | | general assembly, including, but not limited to, bills and resolutions |
---|
52 | 52 | | excluded from the limitation imposed in subdivision (a)(2) and repassage |
---|
53 | 53 | | of bills and resolutions over an executive veto. |
---|
54 | 54 | | (b) |
---|
55 | 55 | | (1) For the purposes of this section, "ninety-nine (99) bills and |
---|
56 | 56 | | resolutions" does not include: |
---|
57 | 57 | | (A) General bills with local application and private acts; |
---|
58 | 58 | | (B) Resolutions that are memorializing or congratulatory in |
---|
59 | 59 | | nature and are not referred to a standing committee; |
---|
60 | 60 | | (C) Resolutions that are procedural in nature and are not |
---|
61 | 61 | | referred to a standing committee; and |
---|
62 | 62 | | (D) Supplemental appropriations bills, bond bills, index |
---|
63 | 63 | | bills, and bills that contain the following language in their caption: |

71 | 71 | | (A) The ninety-nine (99) bills and resolutions for the |
---|
72 | 72 | | September session of the general assembly must be pre-filed for |
---|
73 | 73 | | introduction by twelve o'clock (12:00) noon central daylight time |
---|
74 | 74 | | (CDT) on the third Thursday in August prior to the September |
---|
75 | 75 | | session. Each member of the house of representatives may file |
---|
76 | 76 | | one (1) bill or resolution and each member of the senate may file |
---|
77 | 77 | | up to three (3) bills or resolutions. Bills and resolutions introduced |
---|
78 | 78 | | for the September session may be acted upon during the |
---|
79 | 79 | | September session or during the second annual session of the |
---|
80 | 80 | | general assembly beginning in January of the following year. |
---|
81 | 81 | | (B) Bills described in subdivision (b)(1)(D) must be pre- |
---|
82 | 82 | | filed for introduction by twelve o'clock (12:00) noon central daylight |
---|
83 | 83 | | time (CDT) on the third Thursday in August prior to the September |
---|
84 | 84 | | session. |
---|
85 | 85 | | (C) Bills and resolutions described in subdivisions |
---|
86 | 86 | | (b)(1)(A)-(C) may be filed at any time prior to the conclusion of the |
---|
87 | 87 | | September session. |
---|
88 | 88 | | (D) No bills or resolutions required to be pre-filed in |
---|
89 | 89 | | accordance with subdivisions (b)(2)(A) or (B) may be introduced |
---|
90 | 90 | | through the delayed bills committee of either house. |

---|
96 | 96 | | board, commission, or other entity, the September session of the general assembly will |
---|
97 | 97 | | not be considered an annual legislative session or a regular session. |
---|
98 | 98 | | SECTION 2. Tennessee Code Annotated, Section 2-10-310, is amended by adding the |
---|
99 | 99 | | following as a new subsection: |
---|
100 | 100 | | ( ) As used in this section, "general assembly session period" means the period |
---|
101 | 101 | | from: |
---|
102 | 102 | | (1) The convening of the general assembly in organizational session to |
---|
103 | 103 | | the earlier of the last day of regular session or June 1, in odd years; |
---|
104 | 104 | | (2) The convening of the general assembly in regular session to the |
---|
105 | 105 | | earlier of May 15 or the conclusion of the annual session in even years; and |
---|
106 | 106 | | (3) The convening of the general assembly in any extraordinary or |
---|
107 | 107 | | September session through the conclusion of such extraordinary or September |
---|
108 | 108 | | session. |
---|
109 | 109 | | SECTION 3. Tennessee Code Annotated, Section 2-10-310(a)(1), is amended by |
---|
110 | 110 | | deleting the subdivision and substituting the following: |
---|
111 | 111 | | Except as provided in subdivisions (a)(2) and (3), during the general assembly |
---|
112 | 112 | | session period, a member of the general assembly or a member's campaign committee |
---|
113 | 113 | | or the governor or the governor's campaign committee shall not conduct a fundraiser or |
---|
114 | 114 | | solicit or accept contributions for the benefit of the caucus, any caucus member, or |
---|
115 | 115 | | member or candidate of the general assembly or governor. |
---|
116 | 116 | | SECTION 4. Tennessee Code Annotated, Section 2-10-310(b), is amended by deleting |
---|
117 | 117 | | the subsection and substituting the following: |
---|
118 | 118 | | During the general assembly session period, a political campaign committee |
---|
119 | 119 | | controlled by a political party on the national, state, or local level, or controlled by a |
---|

124 | 124 | | caucus of such political party established by members of either house of the general |
---|
125 | 125 | | assembly, or established or controlled by any member of the general assembly, that |

127 | 127 | | to defray the expenses of such person's office shall not conduct a fundraiser or solicit or |
---|
128 | 128 | | accept contributions for the benefit of the caucus, any caucus member, or candidate for |
---|
129 | 129 | | the general assembly or governor. |
---|
130 | 130 | | SECTION 5. This act takes effect upon becoming a law, the public welfare requiring it. |
---|
