1313 AN ACT to amend Tennessee Code Annotated, Title 2 and
1414 Title 3, relative to the general assembly.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Title 3, Chapter 1, is amended by adding the
1818 following language as a new part:
1919 3-1-301. The general assembly shall convene for a September session on the
2020 Tuesday immediately following Labor Day in each odd-numbered year and shall adjourn
2121 no later than September 30 of the same year.
2222 3-1-302. At the conclusion of the first annual session of each general assembly,
2323 the adjournment resolution must provide that the general assembly will reconvene at
2424 twelve o'clock (12:00) noon central daylight time (CDT) on the Tuesday immediately
2525 following Labor Day in September of each odd-numbered year.

2727 (a) Notwithstanding any rule of the senate or house of representatives to
2828 the contrary, this part governs the biennial September sessions of the general
2929 assembly.
3030 (b) All procedural provisions of this title and all rules of the senate and
3131 house of representatives not inconsistent with this part are applicable to biennial
3232 September sessions of the general assembly.
3333 (c) The committee on rules for each house shall meet prior to the
3434 Thursday following Labor Day in September of each odd-numbered year to

3939 consider additional rule amendments and suspensions necessary for the
4040 effective and efficient operation of the September session.
4141 (d) The September session must be funded through the existing budget
4242 for the general assembly's legislative session.
4343 3-1-304.
4444 (a) During the September session, the general assembly may consider
4545 the following:
4646 (1) All bills and resolutions filed prior to adjournment of the first
4747 annual session of the general assembly;
4848 (2) Ninety-nine (99) bills and resolutions filed for the September
4949 session of the general assembly in accordance with subsection (b); and
5050 (3) Other matters deemed appropriate and necessary by the
5151 general assembly, including, but not limited to, bills and resolutions
5252 excluded from the limitation imposed in subdivision (a)(2) and repassage
5353 of bills and resolutions over an executive veto.

5555 (1) For the purposes of this section, "ninety-nine (99) bills and
5656 resolutions" does not include:
5757 (A) General bills with local application and private acts;
5858 (B) Resolutions that are memorializing or congratulatory in
5959 nature and are not referred to a standing committee;
6060 (C) Resolutions that are procedural in nature and are not
6161 referred to a standing committee; and
6262 (D) Supplemental appropriations bills, bond bills, index
6363 bills, and bills that contain the following language in their caption:

6868 Relative to statutory revisions required for implementation
6969 of the supplemental appropriations act.

7171 (A) The ninety-nine (99) bills and resolutions for the
7272 September session of the general assembly must be pre-filed for
7373 introduction by twelve o'clock (12:00) noon central daylight time
7474 (CDT) on the third Thursday in August prior to the September
7575 session. Each member of the house of representatives may file
7676 one (1) bill or resolution and each member of the senate may file
7777 up to three (3) bills or resolutions. Bills and resolutions introduced
7878 for the September session may be acted upon during the
7979 September session or during the second annual session of the
8080 general assembly beginning in January of the following year.
8181 (B) Bills described in subdivision (b)(1)(D) must be pre-
8282 filed for introduction by twelve o'clock (12:00) noon central daylight
8383 time (CDT) on the third Thursday in August prior to the September
8484 session.
8585 (C) Bills and resolutions described in subdivisions
8686 (b)(1)(A)-(C) may be filed at any time prior to the conclusion of the
8787 September session.
8888 (D) No bills or resolutions required to be pre-filed in
8989 accordance with subdivisions (b)(2)(A) or (B) may be introduced
9090 through the delayed bills committee of either house.

9595 3-1-305. For purposes of appointments and confirmations of any person to a
9696 board, commission, or other entity, the September session of the general assembly will
9797 not be considered an annual legislative session or a regular session.
9898 SECTION 2. Tennessee Code Annotated, Section 2-10-310, is amended by adding the
9999 following as a new subsection:
100100 ( ) As used in this section, "general assembly session period" means the period
101101 from:
102102 (1) The convening of the general assembly in organizational session to
103103 the earlier of the last day of regular session or June 1, in odd years;
104104 (2) The convening of the general assembly in regular session to the
105105 earlier of May 15 or the conclusion of the annual session in even years; and
106106 (3) The convening of the general assembly in any extraordinary or
107107 September session through the conclusion of such extraordinary or September
108108 session.
109109 SECTION 3. Tennessee Code Annotated, Section 2-10-310(a)(1), is amended by
110110 deleting the subdivision and substituting the following:
111111 Except as provided in subdivisions (a)(2) and (3), during the general assembly
112112 session period, a member of the general assembly or a member's campaign committee
113113 or the governor or the governor's campaign committee shall not conduct a fundraiser or
114114 solicit or accept contributions for the benefit of the caucus, any caucus member, or
115115 member or candidate of the general assembly or governor.
116116 SECTION 4. Tennessee Code Annotated, Section 2-10-310(b), is amended by deleting
117117 the subsection and substituting the following:
118118 During the general assembly session period, a political campaign committee
119119 controlled by a political party on the national, state, or local level, or controlled by a

124124 caucus of such political party established by members of either house of the general
125125 assembly, or established or controlled by any member of the general assembly, that
126126 makes contributions to a candidate for the general assembly or governor for election or
127127 to defray the expenses of such person's office shall not conduct a fundraiser or solicit or
128128 accept contributions for the benefit of the caucus, any caucus member, or candidate for
129129 the general assembly or governor.
130130 SECTION 5. This act takes effect upon becoming a law, the public welfare requiring it.
