17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 17 | | SECTION 1. Tennessee Code Annotated, Title 13, Chapter 21, is amended by adding |
---|
19 | 18 | | the following as a new part: |
---|
20 | 19 | | 13-21-401. |
---|
21 | 20 | | As used in this part: |
---|
22 | 21 | | (1) "Dwelling unit" means a building or structure or part thereof that is |
---|
23 | 22 | | used for a home or residence by one (1) or more persons who maintain a |
---|
24 | 23 | | household; |
---|
25 | 24 | | (2) "Governing body" means the council, commission, or board, or other |
---|
26 | 25 | | legislative body, charged with governing a municipality; |
---|
27 | 26 | | (3) "Municipality" means any county, including any county having a |
---|
28 | 27 | | metropolitan form of government, or incorporated city or town in this state; and |
---|
29 | 28 | | (4) "Residential rental dwelling unit" means a dwelling unit that is leased |
---|
30 | 29 | | or rented to one (1) or more tenants. However, a dwelling unit occupied in part |
---|
31 | 30 | | by the dwelling unit owner is not a residential rental dwelling unit unless |
---|
32 | 31 | | otherwise provided by the zoning ordinance of the municipality. |

---|
34 | 33 | | (a) A municipality may create, implement, and enforce a rental property registry |
---|
35 | 34 | | for all residential rental dwelling units within the municipality's jurisdiction. |

40 | 39 | | (b) A municipal registry of residential rental dwelling units must include, at a |
---|
41 | 40 | | minimum, the following: |
---|
42 | 41 | | (1) The physical address of each residential rental dwelling unit; |
---|
43 | 42 | | (2) The name, mailing address, and contact information of the owner of |
---|
44 | 43 | | the residential rental dwelling unit; |
---|
45 | 44 | | (3) The name and contact information of the property management entity |
---|
46 | 45 | | for the residential rental dwelling unit, if any; |
---|
47 | 46 | | (4) The number of separate rental units at the residential rental dwelling |
---|
48 | 47 | | unit; and |
---|
49 | 48 | | (5) Verification that the residential rental dwelling unit complies with |
---|
50 | 49 | | applicable building codes, zoning ordinances, and health and safety regulations. |
---|

---|
52 | 51 | | (a) Each owner of a residential rental dwelling unit located in a municipality that |
---|
53 | 52 | | adopts a registry pursuant to § 13-21-402 shall register the residential rental dwelling |
---|
54 | 53 | | unit with the municipality on an annual basis. |
---|
55 | 54 | | (b) A municipality may charge a reasonable fee to cover administrative costs |
---|
56 | 55 | | associated with maintaining the registry. |
---|
57 | 56 | | (c) A failure by an owner to register a residential rental dwelling unit may result |
---|
58 | 57 | | in civil penalties or other legal action, as established by the governing body of the |
---|
59 | 58 | | municipality. |
---|
60 | 59 | | (d) The following properties are exempt from registration under this section: |
---|
61 | 60 | | (1) Owner-occupied residential rental dwelling units that rent fewer than |
---|
62 | 61 | | two (2) units on the premises; and |
---|
63 | 62 | | (2) Residential rental dwelling units owned by governmental or quasi- |
---|
64 | 63 | | governmental entities. |

70 | 69 | | (a) A municipality that adopts a registry pursuant to § 13-21-402 shall integrate |
---|
71 | 70 | | the registry into the municipality's code enforcement processes to assist in monitoring |
---|
72 | 71 | | and enforcing compliance with health, safety, and housing standards. |
---|
73 | 72 | | (b) A municipality may inspect a registered residential rental dwelling unit to |
---|
74 | 73 | | ensure compliance, consistent with state and local laws. |
---|
75 | 74 | | 13-21-405. |
---|
76 | 75 | | (a) Non-sensitive information that is contained in a registry established under |
---|
77 | 76 | | this part is not confidential and may be made accessible to tenants and the public. |
---|
78 | 77 | | (b) Proprietary or personal information contained in a registry established under |
---|
79 | 78 | | this part is confidential and not open to inspection as a public record. |
---|
80 | 79 | | 13-21-406. |
---|
81 | 80 | | This part does not preempt or override any existing state law or rule, but must be |
---|
82 | 81 | | construed to supplement such laws and rules. |

---|
84 | 83 | | A municipality that establishes a registry under this part shall submit an annual |
---|
85 | 84 | | report to the department of economic and community development, in such manner as |
---|
86 | 85 | | the department may require, that details the following: |
---|
87 | 86 | | (1) The number of properties registered; |
---|
88 | 87 | | (2) Code violations identified and resolved; and |
---|
89 | 88 | | (3) The overall effectiveness of the registry in improving housing |
---|
90 | 89 | | conditions. |
---|
91 | 90 | | SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it. |
