1313 AN ACT to amend Tennessee Code Annotated, Title 5;
1414 Title 6; Title 7; Title 13; Title 54 and Title 66,
1515 relative to real property development.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Title 13, is amended by adding the following
1919 as a new chapter:
2020 13-31-101.
2121 As used in this chapter, unless context provides otherwise:
2222 (1) "Development property" means real property that is being built, improved
2323 upon, or developed by a landowner, developer, or builder for the purposes of developing
2424 a property, and applies only to:
2525 (A) Residential developments under three hundred (300) single-
2626 family homes; and
2727 (B) Multi-family residences under five hundred (500) units;
2828 (2) "Infrastructure" includes roads, bridges, highways, traffic lights, toll roads,
2929 road signage, barricades, turn lanes, utility poles, electrical lines, internet cabling, and
3030 entrances to a development property; and
3131 (3) "Nonessential infrastructure":
3232 (A) Means any infrastructure that is not required for the creation, ongoing
3333 maintenance, and growth of a development property of a landowner, developer,
3434 or builder; and
3535 (B) Includes property that is not contiguous to the development property.

4141 A state, county, or municipal government shall not, in connection to a
4242 development property, require a landowner, developer, or builder to fund, build, or
4343 contribute to the development of:
4444 (1) Nonessential infrastructure that is not contiguous or adjacent to a
4545 development property of a landowner, developer, or builder; or
4646 (2) Nonessential infrastructure beyond the anticipated infrastructure
4747 needed for the development property as estimated at the start of the
4848 development of the development property. For purposes of this subdivision (2),
4949 development of a property constitutes any point from the initial planning stage
5050 through to the completion of the development property.
5151 SECTION 2. This act does not repeal or modify any tax, property, zoning, or permitting
5252 laws or ordinance, nor any administrative authority granted to an administrative agency, nor any
5353 other applicable state, local, or federal laws.
5454 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it, and
5555 applies to contracts entered into, renewed, or amended on or after that date.
