17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Title 13, is amended by adding the following |
---|
19 | 19 | | as a new chapter: |
---|
20 | 20 | | 13-31-101. |
---|
21 | 21 | | As used in this chapter, unless context provides otherwise: |
---|
22 | 22 | | (1) "Development property" means real property that is being built, improved |
---|
23 | 23 | | upon, or developed by a landowner, developer, or builder for the purposes of developing |
---|
24 | 24 | | a property, and applies only to: |
---|
25 | 25 | | (A) Residential developments under three hundred (300) single- |
---|
26 | 26 | | family homes; and |
---|
27 | 27 | | (B) Multi-family residences under five hundred (500) units; |
---|
28 | 28 | | (2) "Infrastructure" includes roads, bridges, highways, traffic lights, toll roads, |
---|
29 | 29 | | road signage, barricades, turn lanes, utility poles, electrical lines, internet cabling, and |
---|
30 | 30 | | entrances to a development property; and |
---|
31 | 31 | | (3) "Nonessential infrastructure": |
---|
32 | 32 | | (A) Means any infrastructure that is not required for the creation, ongoing |
---|
33 | 33 | | maintenance, and growth of a development property of a landowner, developer, |
---|
34 | 34 | | or builder; and |
---|
35 | 35 | | (B) Includes property that is not contiguous to the development property. |

41 | 41 | | A state, county, or municipal government shall not, in connection to a |
---|
42 | 42 | | development property, require a landowner, developer, or builder to fund, build, or |
---|
43 | 43 | | contribute to the development of: |
---|
44 | 44 | | (1) Nonessential infrastructure that is not contiguous or adjacent to a |
---|
45 | 45 | | development property of a landowner, developer, or builder; or |
---|
46 | 46 | | (2) Nonessential infrastructure beyond the anticipated infrastructure |
---|
47 | 47 | | needed for the development property as estimated at the start of the |
---|
48 | 48 | | development of the development property. For purposes of this subdivision (2), |
---|
49 | 49 | | development of a property constitutes any point from the initial planning stage |
---|
50 | 50 | | through to the completion of the development property. |
---|
51 | 51 | | SECTION 2. This act does not repeal or modify any tax, property, zoning, or permitting |
---|
52 | 52 | | laws or ordinance, nor any administrative authority granted to an administrative agency, nor any |
---|
53 | 53 | | other applicable state, local, or federal laws. |
---|
54 | 54 | | SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it, and |
---|
55 | 55 | | applies to contracts entered into, renewed, or amended on or after that date. |
