16 | 15 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 16 | | SECTION 1. Tennessee Code Annotated, Section 63-6-207(g), is amended by deleting |
---|
18 | 17 | | the subsection and substituting: |

19 | 18 | | (g) |
---|
20 | 19 | | (1) The board shall issue a foreign training license of limited duration to |
---|
21 | 20 | | an internationally licensed physician who has successfully completed the |
---|
22 | 21 | | examination as described in subsection (b) upon finding sufficient evidence that |
---|
23 | 22 | | the internationally licensed physician: |
---|
24 | 23 | | (A) Possesses a: |
---|
25 | 24 | | (i) Certificate from a medical school whose curriculum is: |
---|
26 | 25 | | (a) Approved by the American Medical Association |
---|
27 | 26 | | or its extant accreditation program for medical education, |
---|
28 | 27 | | or its successor; or |
---|
29 | 28 | | (b) Judged to be acceptable by the board; and |
---|
30 | 29 | | (ii) Copy of a permanent ECFMG certificate; |
---|
31 | 30 | | (B) Completed a postgraduate training program of a minimum of |
---|
32 | 31 | | three (3) years in a country approved by the internationally licensed |
---|
33 | 32 | | physician's licensing country or has practiced as a medical professional |
---|
34 | 33 | | performing the duties of a physician for seven (7) years; |
---|

39 | 38 | | (C) Has practiced as a medical professional performing the duties |
---|
40 | 39 | | of a physician for at least three (3) years in the licensing country after the |
---|
41 | 40 | | postgraduate training or equivalent as described in subdivision (g)(1)(B); |
---|
42 | 41 | | (D) Has been in good standing with the medical licensing or |
---|
43 | 42 | | regulatory institution of the internationally licensed physician licensing |
---|
44 | 43 | | country within the last five (5) years and does not have any pending |
---|
45 | 44 | | discipline before the licensing body; |
---|
46 | 45 | | (E) Is legally entitled to live or work in the United States if the |
---|
47 | 46 | | person is not a citizen of the United States; |
---|
48 | 47 | | (F) Has sufficient evidence of good moral character; and |
---|
49 | 48 | | (G) Has paid: |
---|
50 | 49 | | (i) A nonrefundable application fee as set by the board; |
---|
51 | 50 | | and |
---|
52 | 51 | | (ii) An examination fee as described in this section. |
---|
53 | 52 | | (2) An applicant under subdivision (g)(1) shall submit sufficient evidence |
---|
54 | 53 | | that the applicant is an internationally licensed physician and has an offer for |
---|
55 | 54 | | employment as a physician at a healthcare provider that operates in this state. |
---|
56 | 55 | | (3) An internationally licensed physician who is granted a foreign training |
---|
57 | 56 | | license under subdivision (g)(1) shall only provide medical services at the |
---|
58 | 57 | | healthcare provider identified in subdivision (g)(2) during the period of the foreign |
---|
59 | 58 | | training license unless the licensee notifies the board of a change of eligible |
---|
60 | 59 | | healthcare provider employer. |
---|
61 | 60 | | (4) The board may grant a full and unrestricted license to practice |
---|
62 | 61 | | medicine to a foreign training licensee under subdivision (g)(1) who is in good |
---|

67 | 66 | | standing and has actively practiced medicine in this state for two (2) years after |
---|
68 | 67 | | the date of foreign training licensure. |
---|
69 | 68 | | (5) As used in this subsection (g), "healthcare provider" means an |
---|
70 | 69 | | individual, entity, corporation, person, or organization, whether for profit or |
---|
71 | 70 | | nonprofit, that furnishes, bills, or is paid for a healthcare procedure or service |
---|
72 | 71 | | delivery in the normal course of business, and includes a healthcare |
---|
73 | 72 | | professional, healthcare facility, a health system, hospital, hospital-based facility, |
---|
74 | 73 | | freestanding emergency facility, urgent care clinic, or entity licensed or certified |
---|
75 | 74 | | to provide health services in this state as recognized by the board. |
---|
76 | 75 | | SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it. |
