| 16 | 16 | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: | |
| 17 | 17 | SECTION 1. Tennessee Code Annotated, Section 44-2-102, is amended by deleting | |
| 18 | 18 | subdivision (4) and substituting: | |
| 19 | 19 | (4) | |
| 20 | 20 | (A) Recommend tests or vaccinations of animals within this state or | |
| 21 | 21 | imported into this state for the purpose of protecting the health of animals in this | |
| 22 | 22 | state; and | |
| 23 | 23 | (B) Order tests or vaccinations of animals within this state or imported | |
| 24 | 24 | into this state for the purpose of protecting the health of animals in this state, if | |
| 25 | 25 | each specific vaccination and test ordered has received prior approval from the | |
| 26 | 26 | joint government operations committee of the house of representatives and the | |
| 27 | 27 | senate; | |
| 28 | 28 | SECTION 2. Tennessee Code Annotated, Section 44-2-102, is amended by deleting | |
| 29 | 29 | subdivision (6). | |
| 30 | 30 | SECTION 3. Tennessee Code Annotated, Section 44-2-105, is amended by deleting the | |
| 31 | 31 | section and substituting instead: | |
| 32 | 32 | The commissioner, through rules, shall establish procedures for the payment of | |
| 33 | 33 | indemnities for animals destroyed under the authority of this chapter. Indemnity under | |
| 34 | 34 | this section is based on, but not limited to, the value of the animal and the availability of | |
| 35 | 35 | funds for that purpose. | |
