1313 AN ACT to amend Tennessee Code Annotated, Title 28
1414 and Title 40, Chapter 2, relative to commencement
1515 of proceedings.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Section 40-2-101(q)(3)(B), is amended by
1919 deleting the subdivision and substituting:
2020 (B)
2121 (i) For offenses occurring on or after July 1, 2019, but before July 1,
2222 2025, in order to commence prosecution for an offense listed in subdivision (q)(1)
2323 under the circumstances described in subdivision (q)(3)(A), at a date that is more
2424 than twenty-five (25) years from the date the victim becomes eighteen (18) years
2525 of age, the prosecution is required to offer admissible and credible evidence
2626 corroborating the allegations or similar acts by the defendant.
2727 (ii) For offenses occurring on or after July 1, 2025, in order to commence
2828 prosecution for an offense listed in subdivision (q)(1) under the circumstances
2929 described in subdivision (q)(3)(A), at a date that is more than thirty (30) years
3030 from the date the victim becomes eighteen (18) years of age, the prosecution is
3131 required to offer admissible and credible evidence corroborating the allegations
3232 or similar acts by the defendant.
3333 SECTION 2. Tennessee Code Annotated, Section 40-2-101(q)(4), is amended by
3434 deleting the subdivision and substituting:
3535 (4) This subsection (q) applies to offenses:

4040 (A) Committed on or after July 1, 2019, except as provided in subdivision
4141 (q)(3)(B); or
4242 (B) Committed prior to July 1, 2019, unless prosecution for the offense is
4343 barred because the applicable time limitation set out in this section for
4444 prosecution of the offense expired prior to July 1, 2019.
4545 SECTION 3. Tennessee Code Annotated, Section 28-3-116(b)(2), is amended by
4646 deleting the language "on or after July 1, 2019" and substituting "on or after July 1, 2019, but
4747 before July 1, 2025".
4848 SECTION 4. Tennessee Code Annotated, Section 28-3-116(b), is amended by adding
4949 the following new subdivision:
5050 (3) For child sexual abuse that occurred on or after July 1, 2025, within the later
5151 of:
5252 (A) Thirty (30) years from the date the person becomes eighteen (18)
5353 years of age; or
5454 (B) If the injury or illness was not discovered at the time of the abuse,
5555 within three (3) years from the time of discovery of the abuse by the injured
5656 person.
5757 SECTION 5. This act takes effect July 1, 2025, the public welfare requiring it.
