17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Section 40-2-101(q)(3)(B), is amended by |
---|
19 | 19 | | deleting the subdivision and substituting: |

20 | 20 | | (B) |
---|
21 | 21 | | (i) For offenses occurring on or after July 1, 2019, but before July 1, |
---|
22 | 22 | | 2025, in order to commence prosecution for an offense listed in subdivision (q)(1) |
---|
23 | 23 | | under the circumstances described in subdivision (q)(3)(A), at a date that is more |
---|
24 | 24 | | than twenty-five (25) years from the date the victim becomes eighteen (18) years |
---|
25 | 25 | | of age, the prosecution is required to offer admissible and credible evidence |
---|
26 | 26 | | corroborating the allegations or similar acts by the defendant. |
---|
27 | 27 | | (ii) For offenses occurring on or after July 1, 2025, in order to commence |
---|
28 | 28 | | prosecution for an offense listed in subdivision (q)(1) under the circumstances |
---|
29 | 29 | | described in subdivision (q)(3)(A), at a date that is more than thirty (30) years |
---|
30 | 30 | | from the date the victim becomes eighteen (18) years of age, the prosecution is |
---|
31 | 31 | | required to offer admissible and credible evidence corroborating the allegations |
---|
32 | 32 | | or similar acts by the defendant. |

33 | 33 | | SECTION 2. Tennessee Code Annotated, Section 40-2-101(q)(4), is amended by |
---|
34 | 34 | | deleting the subdivision and substituting: |

35 | 35 | | (4) This subsection (q) applies to offenses: |

43 | 43 | | barred because the applicable time limitation set out in this section for |
---|
44 | 44 | | prosecution of the offense expired prior to July 1, 2019. |

45 | 45 | | SECTION 3. Tennessee Code Annotated, Section 28-3-116(b)(2), is amended by |
---|
46 | 46 | | deleting the language "on or after July 1, 2019" and substituting "on or after July 1, 2019, but |
---|
47 | 47 | | before July 1, 2025". |
---|
48 | 48 | | SECTION 4. Tennessee Code Annotated, Section 28-3-116(b), is amended by adding |
---|
49 | 49 | | the following new subdivision: |
---|
50 | 50 | | (3) For child sexual abuse that occurred on or after July 1, 2025, within the later |
---|
51 | 51 | | of: |
---|
52 | 52 | | (A) Thirty (30) years from the date the person becomes eighteen (18) |
---|
53 | 53 | | years of age; or |
---|
54 | 54 | | (B) If the injury or illness was not discovered at the time of the abuse, |
---|
55 | 55 | | within three (3) years from the time of discovery of the abuse by the injured |
---|
56 | 56 | | person. |
---|
57 | 57 | | SECTION 5. This act takes effect July 1, 2025, the public welfare requiring it. |
