1312 AN ACT to amend Tennessee Code Annotated, Title 39,
1413 Chapter 17, Part 13, relative to confiscated
1514 weapons.

1716 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1817 SECTION 1. Tennessee Code Annotated, Section 39-17-1317(b), is amended by
1918 adding the following new subdivision:
2019 ( ) Destroyed or recycled.
2120 SECTION 2. Tennessee Code Annotated, Section 39-17-1317(g)(1), is amended by
2221 deleting the subdivision and substituting:
2322 (1) A weapon that may be evidence in an official proceeding shall be retained or
2423 otherwise preserved in accordance with the rules or practices regulating the preservation
2524 of evidence. The weapon shall be sold, destroyed, recycled, or retained for legitimate
2625 law enforcement purposes not less than sixty (60) days nor more than one hundred
2726 eighty (180) days after the last legal proceeding involving the weapon; provided, that the
2827 requirements of subdivision (g)(2) have been met; and
2928 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
