16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Title 47, Chapter 18, Part 1, is amended by |
---|
18 | 18 | | adding the following as a new section: |
---|
19 | 19 | | 47-18-136. |
---|
20 | 20 | | (a) As used in this section: |
---|
21 | 21 | | (1) "Company" means a for-profit or not-for-profit organization, |
---|
22 | 22 | | association, corporation, partnership, joint venture, limited partnership, limited |
---|
23 | 23 | | liability partnership, limited liability company, or other entity or business |
---|
24 | 24 | | association, including all wholly owned subsidiaries, majority-owned subsidiaries, |
---|
25 | 25 | | parent companies, or affiliates of those entities or business associations; |
---|
26 | 26 | | (2) "Net metering credit" means a billing mechanism that credits a solar |
---|
27 | 27 | | energy system owner or user for the electricity or energy the solar energy system |
---|
28 | 28 | | adds to the utility grid; |
---|
29 | 29 | | (3) "Solar energy system" or "system" means a device, mechanism, |
---|
30 | 30 | | structure, apparatus, or part thereof, whose primary purpose is to collect solar |
---|
31 | 31 | | energy and convert and store it for useful purposes, including heating and |
---|
32 | 32 | | cooling buildings or other energy saving processes, or to produce generated |
---|
33 | 33 | | power by means of any combination of collecting, transferring, or converting |
---|
34 | 34 | | solar-generated energy; and |
---|
35 | 35 | | (4) "Utility" means: |
---|

40 | 40 | | (A) A public utility, as defined under § 65-4-101, that provides |
---|
41 | 41 | | electricity; |
---|
42 | 42 | | (B) A municipal or county-owned utility that provides electricity; or |
---|
43 | 43 | | (C) A cooperative, as defined under § 65-25-102. |
---|
44 | 44 | | (b) A company offering to sell or install a solar energy system must provide |
---|
45 | 45 | | written proof that the utility serving the area where the system is to be installed has a net |
---|
46 | 46 | | metering program or otherwise offers net metering credits to an owner or user of a |
---|
47 | 47 | | system before the company enters into an agreement to sell or install the system. The |
---|
48 | 48 | | written proof required by this subsection (b) must include: |
---|
49 | 49 | | (1) A description of how the net metering program works, including the |
---|
50 | 50 | | requirements to participate; applicable fees related to participation; and the |
---|
51 | 51 | | general or anticipated buyback or crediting rate; and |
---|
52 | 52 | | (2) A notarized signature or document from the utility verifying that the |
---|
53 | 53 | | utility has a net metering program or otherwise offers net metering credits to an |
---|
54 | 54 | | owner or user of a solar energy system in the area in which the system is to be |
---|
55 | 55 | | installed. |
---|
56 | 56 | | (c) A violation of subsection (b) constitutes a violation of this part as an unfair or |
---|
57 | 57 | | deceptive act or practice affecting the conduct of trade or commerce, and is subject to |
---|
58 | 58 | | the penalties and remedies as provided by this part. Each act in violation of subsection |
---|
59 | 59 | | (b) constitutes a separate violation of this part. |
---|
60 | 60 | | SECTION 2. Tennessee Code Annotated, Section 47-18-104(b), is amended by adding |
---|
61 | 61 | | the following as a new subdivision: |
---|
62 | 62 | | ( ) Violating § 47-18-136; |
---|
63 | 63 | | SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it, and |
---|
64 | 64 | | applies to agreements entered into or modified on or after that date. |
