1313 AN ACT to amend Tennessee Code Annotated, Title 7,
1414 Chapter 35; Title 7, Chapter 82 and Title 68,
1515 Chapter 221, relative to sewer systems.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Title 7, Chapter 35, Part 4, is amended by
1919 adding the following as a new section:
2020 A city or town that has operated a sewerage system outside of the corporate
2121 boundaries of the city or town for twenty-five (25) years or more shall not cease
2222 operating the sewerage system outside the corporate boundaries so long as the
2323 sewerage system maintains sufficient capacity, as determined by a study conducted by
2424 the Tennessee advisory commission on intergovernmental relations (TACIR).
2525 SECTION 2. Tennessee Code Annotated, Title 7, Chapter 82, Part 3, is amended by
2626 adding the following as a new section:
2727 A utility district that has operated a sewerage system in the unincorporated
2828 territory of a county for twenty-five (25) years or more shall not cease operating the
2929 sewerage system in the unincorporated territory so long as the sewerage system
3030 maintains sufficient capacity, as determined by a study conducted by the Tennessee
3131 advisory commission on intergovernmental relations (TACIR).
3232 SECTION 3. Tennessee Code Annotated, Title 68, Chapter 221, Part 2, is amended by
3333 adding the following as a new section:
3434 A municipality that has operated a sewage treatment works outside of the
3535 corporate boundaries of the city or town for twenty-five (25) years or more shall not
3636 cease operating the sewage treatment works outside the corporate boundaries so long

4141 as the sewage treatment works maintains sufficient capacity, as determined by a study
4242 conducted by the Tennessee advisory commission on intergovernmental relations
4343 (TACIR).
4444 SECTION 4. This act takes effect upon becoming a law, the public welfare requiring it.
